Judge's Consideration Behind 5 Years In Prison Helena Lim

The panel of judges has several considerations behind the five-year prison sentence against the defendant Helena Lim in a series of cases of alleged corruption in the management of tin commodity trading in the Mining Business Permit (IUP) area at PT Timah Tbk for the 2015-2022 period.

The burdensome consideration is that Helena Lim's actions are considered not to support the government's program in eradicating corruption.

"The aggravating thing is that the defendant's actions do not support the government's program in the context of relaxing the state which is clean and free from corruption, collusion and nepotism," said the judge during a trial at the Corruption Court, Jakarta, Monday, December 30.

Meanwhile, for mitigating matters, the panel of judges had several considerations. One of them, the defendant Helena Lim, was considered polite.

"The mitigating factor for the defendant has never been convicted, being polite during the trial, is the backbone of the family, and the defendant regrets his actions," said the judge.

In the verdict, Helena Lim was found guilty. Thus, he was sentenced to five years in prison.

Not only imprisonment, Crazy Rich Pantai Indah Kapuk (PIK) as well as the owner of the PT Quantum Skyline Exchange was also sentenced to a fine of Rp. 750 million.

If the defendant cannot pay the fine, it will be replaced with imprisonment for 6 months.

"A fine of Rp. 750 million, provided that if the fine is not paid, it will be replaced with imprisonment for 6 months," said the judge.

The verdict of the panel of judges was lighter than the prosecutor's demands. Helena Lim was previously sentenced to eight years in prison.

In the tin corruption case, Helena Lim and Harvey Moies are said to have received Rp420 billion.
