Proven Corruption Of Zikr Land, Former Head Of PUPR Banda Aceh Sentenced To One Year In Prison

The panel of judges at the Corruption Court at the Banda Aceh District Court sentenced the former Head of the Banda Aceh City Public Works and Spatial Planning (Kadis PUPR) M Yasir to one year in prison for being proven guilty of corruption in land or land acquisition for remembrance.

The verdict was read out by the panel of judges chaired by Teuku Syarafi accompanied by Harmi Jaya and Heri Alfian each as member judges during a trial at the Corruption Court at the Banda Aceh District Court in Banda Aceh, Monday, November 4.

In addition to imprisonment, the panel of judges also sentenced the defendant M Yasir to pay a fine of Rp. 50 million with a subsidiary or compensation if he did not pay for one month in prison.

The panel of judges stated that the defendant was legally and convincingly proven guilty of violating Article 3 Paragraph (1) in conjunction with Article 18 Paragraph (1) letters a, b Paragraph (2) and Paragraph (3) of Law Number 31 of 1999 which was changed to Law Number 20 of 2001 concerning the eradication of criminal acts of corruption in conjunction with Article 55 Paragraph (1) of the 1st Criminal Code.

"The consideration of the panel of judges, the defendant as the technical implementing official for the procurement of zikr land causes state losses that benefit others," said the panel of judges as reported by ANTARA.

On this decision, the defendant and his legal adviser and the public prosecutor expressed their thoughts.

The panel of judges gave the parties seven days to think about whether to accept or make an appeal.

The verdict of the panel of judges was lighter than the prosecutor's demands. At the previous trial, Public Prosecutor Sutrisna charged defendant M Yasir with a sentence of two years in prison, as well as a fine of Rp. 100 million with a subsidiary of six months in prison.

The Public Prosecutor stated that the Banda Aceh City Government allocated a budget of IDR 3.27 billion for the procurement of the zhikr Nurul Arafah Islamic Center with an area of more than 1,000 square meters in 2018 and 2019. The land is located in Gampong Ulee Lheue, Meuraxa District, Banda Aceh City.

Several points on the land or land are not known to the owner. Furthermore, Deddy Armansyah as the village head who was charged with separately created a sporadic or land control letter in the name of Sofyan Hadi.

Furthermore, the defendant M Yasir as the Technical Implementation Officer of Activities (PPTK) legalized the land in the name of Sofyan Hadi and made payments by transferring compensation money to a personal account.

"After being traced, it turns out that the land is a former market and aisle which is a local village asset, not an individual property," said the prosecutor.
