Restaurant Owner In Ambon Becomes Suspect Because There Is Flotung In The Police Food Hamlet, Now Wins Pretrial

AMBON - Ambon District Court Judge granted all pretrial requests submitted by Norman Bernaldi, the restaurant owner who was named a suspect in violation of Law Number 8 of 1999 concerning Consumer Protection.

"Granted the petitioner's petition in its entirety and asked the Maluku Police investigators to stop the investigation and investigation process and restore the applicant's good name," said Ambon District Court judge Wilson Shriver as reported by ANTARA, Wednesday, September 18.

The judge also stated that the process of summoning experts for questioning in this case was not in accordance with the applicable legal mechanism because it was not accompanied by an official statement from the relevant agencies, namely the Perindag Service and the Maluku Health Office.

Therefore, the judge stated that the determination and detention of the suspect and the confiscation of evidence were also invalid.

"Unless there is new evidence in this case, investigators are allowed to continue the investigation," said the judge.

Meanwhile, the legal advisory team for pretrial applicant Yani Tabermia, Hendro Was et al, coordinated by Naftali Hatulely, said that his client had been named a suspect since early August 2024 on suspicion of violating Article 62 Juncto Article 8 Paragraph (1) and (3) of the Consumer Protection Law.

"The determination of the suspect was carried out after the Maluku Police Resmob ordered 25 boxes of food, the menu in the form of rice and fish in April 2024 and one box of food, including the found of small white caterpillars orferrants," said Naftali.

It's just that the process of detention and determination of suspects or confiscation of evidence to summoning experts is not in accordance with the mechanism in force in the Criminal Procedure Code so that a pretrial application is submitted to the Ambon District Court.
