Polda Metro Regarding The NIK Profiting Case Supports Dharma-Kun: Bawaslu Authority

Polda Metro Jaya said that the Election Supervisory Agency (Bawaslu) has the authority to handle cases of alleged population identification number (NIK) for the purposes of registering an independent candidate, Dharma Pongrekun-Kun Wardana, in the 2024 Regional Head Election (Pilkada) contestation.

The profiteering case was known to have been reported by Samson to Polda Metro Jaya with registration number LP/B/4830/VIII/2024/SPKT/POLDA METRO JAYA dated August 16, 2024.

"The only institution authorized to receive reports of election violations is the Election Supervisory Agency," said Director of Special Criminal Investigation of the Metro Jaya Police Kombes Ade Safri Simanjuntak to VOI, Monday, August 19.

This is because the handling of the case must be handled specifically or apply the 'Lex Consumte' principle.

This is also specifically regulated in Article 185 A of Law No. 10 of 2016 concerning the second amendment to Law No. 1 of 2015 concerning Stipulation of Government Regulations in Lieu of Law No. 1 of 2014 concerning the Election of Governors, Regents, and Mayors into Law.

Therefore, his authority rests with Bawaslu in accordance with Article 134 paragraph (1) of the Law of the Republic number 1 of 2015 concerning the stipulation of government regulations in lieu of Law number 1 of 2014 concerning the election of Governors, Regents, and Mayors as amended and supplemented by Law Number 10 of 2016 concerning the Second Amendment to Law Number 1 of 2015 concerning Stipulation of Government Regulations in Lieu of Law number 1 of 2014 concerning the Election of Governors, Regents, and Mayors.

"Meanwhile, the National Police are the institutions that receive the successor to the report from the Election Supervisory Agency," he said.

Later the investigator will write to the reporter to inform if the alleged profiteering is better reported by Bawaslu.

"It will be submitted to the reporter to report to Bawaslu in advance in accordance with the mechanism that has been regulated in the applicable law. The SP2HP (Notification of Investigation Results) will be sent to the reporter," said Ade.

Later, if the results of Bawaslu's studies and analysis state that what is reported is a criminal act of general election (Pemilu), then Bawaslu will forward the report to the Gakkumdu center.

"The tax process is at the Gakkumdu Center. The mechanism is like that," said Ade.

Polda Metro Jaya has stopped investigating the alleged NIK profiteering case for the purpose of registering an independent candidate, Dharma Pongrekun-Kun Wardana, in the 2024 Regional Head Election (Pilkada) contestation.

The termination of the handling of the case was based on the results of a case conducted on Monday, August 19.

"The title forum agreed to stop the investigation into the handling of the a quo case," said Ade.
