Rahmad explained that the Democrat Party was founded in 2001 by 99 people and there was no SBY's name on the deed of establishment. However, in the Preamble to the 2020 Democratic Party's Articles of Association, only 2 founders of the Democratic Party were mentioned and SBY was named as one of the founders of the party.

"This has caused tremendous anxiety for the party initiators / founders / declarators who are still alive among the 99 people," said Rahmad.

Sociologically, he continued, there was oppression of party members at the grassroots including that experienced by party officials in provinces and districts / cities, especially since SBY's leadership which was then continued by AHY as party chairman.

"The rights of members and administrators are trimmed and limited for various reasons. Charges to cadres are carried out at all levels, while awards or rewards to cadres are almost never given," said Rahmad.

This, said Rahmad, was exacerbated by the existence of political dowries in the pilkada, so that many party cadres were unable to advance in the elections because they were unable to pay dowries to the DPP. In addition, the centralistic and authoritarian conditions of party management by SBY-AHY have deepened the gap between SBY-AHY and regional cadres.

"Philosophically, there is a very strong push to improve democracy and party management within the Democratic Party. This push peaks when the founders, declarators and regional administrators, branches and party members know the contents of the 2020 Democratic Party statutes which are very contrary to principles. -the principles of democracy as mandated by Pancasila, the 1945 Constitution and the Political Party Law Number 2 of 2008 and the amendments to the Political Party Law Number 2 of 2011, "said Rahmad.

He said, the existence of the AD / ART in 2020 confirmed the conclusion that there were efforts by SBY to form a dynasty and oligarchy in the Democratic Party through the AD / ART which gave absolute authority into one hand of SBY as Chairman of the Party High Council.

Juridically, the statutes of political parties are the basic rules of political parties whose changes are made, discussed and ratified or in other words "agreed" in the Congress or Extraordinary Congress. Thus the provisions of Article 5 paragraph (2) of the Political Party Law no. 2 of 2011.

"However, based on the testimony of witnesses to the facts, that the AD ART of the Democratic Party in 2020 was actually made, discussed and ratified outside the Congress," he said.

Then, Article 15 of the Political Party Law no. 2 of 2008 which is not amended in Law no. 2 of 2011 states that the sovereignty of political parties is in the hands of members. However, after seeing the contents of the 2020 AD ART, party sovereignty is in the hands of a single ruler, namely SBY as Chair of the High Council.

"What is very severe is that the process of forming the Democratic Party's AD / ART in 2020 was not discussed and ratified in the Congress as the highest decision-making forum, so the process of forming the AD / ART of the Democratic Party in 2020 actually does not meet the formal requirements, so legally, the AD ART. 2020 is a formal defect, "explained Rahmad.

The Sibolangit KLB, added Rahmad, also found that there were at least 14 (fourteen) articles in the 2020 Democratic Party AD ART that violated the provisions of the Political Party Law. Among other things, the highest power is in the hands of SBY as chairman of the High Council. Candidates for the General Chairperson must be approved by SBY as Chair of the High Council, the AD / ART to be proposed and determined in the Congress or KLB must be drafted by the High Council.

In addition, the authority of the Party Court as an internal judiciary is subordinated to AHY as the General Chairperson and SBY as the Chair of the Party High Council.

"The provisions made in the 2020 AD / ART have amputated the authority of party members and the Party Court. The Democratic Party in resolving Party Internal Disputes does not implement the provisions of the Political Party Law No.2 of 2011, Articles 32-33, because it eliminates the function of the Party Court. as it should be, "said Rahmad.

According to Rahmad, the violations that occurred in the material and / or content of the articles in the 2020 Democratic Party AD / ART were very fatal, because they involved the sovereignty of members of political parties and the forum for the highest decision-making power. As well as the Party Court which is the soul of the Political Party Law no. 2 of 2011.

"Therefore, the 2020 Democratic Party statutes do not meet the objective requirements, so they must be declared null and void because they contradict Article 24 paragraph (3) of the 1945 Constitution, Article 15 paragraph (1) and (2) of the Political Party Law No.2 of 2008. and Article 5 and articles 32-33 of the Political Party Law No. 2 of 2011, "said Rahmad emphasized.
