Rizieq Shihab Signed Compliance Agreement With Prokes During Face-to-Face Session

JAKARTA - The panel of judges at the East Jakarta Court granted the defendant Rizieq Shihab's request regarding the implementation of a face-to-face trial, aka offline.

One of Rizieq Shihab's team of lawyers, Ramdhan Alamsyah, said that he had signed a letter of agreement to comply with health protocols when the trial was held in person. Rizieq also guarantees that there will be no crowds.

"Yes, we (have) signed (the agreement)," said Alamsyah at the East Jakarta District Court, Tuesday, March 23.

Confirmed whether the guarantee of the crowd inside and outside the court. Alamsyah emphasized that the point is that his party will carry out health protocols when the trial is running.

"At the East Jakarta Court," said Alamsyah.

Meanwhile, for those outside the court, his party advised not to crowd. Moreover, Rizieq Shihab's wish had been granted.

"Outside of that, we only appeal not to crowds. We guarantee what is inside," said Alamsyah.

"Those outside we urge not to crowd and order the traffic, which we guarantee is indoors and in the court yard," he said.

The East Jakarta District Court judges decided to grant Rizieq Shihab's request to appear in person at the trial of the alleged violation of the health protocol (prokes) in Petamburan.

Rizieq Shihab will read out the objection or exception note in person at the next trial, Friday, March 26.

"Grants the petitioner's petition (present offline, red)," said presiding judge Suparman Nyompa during a trial at the East Jakarta District Court, Tuesday, March 23.

Therefore, the public prosecutor (JPU) has the obligation to present Rizieq Shihab at the East Jakarta District Court in every trial.

"Ordered that the stipulation of this copy be immediately conveyed to the defendant, his legal adviser, his family, and the East Jakarta District Prosecutor's Office and the state detention center," said Judge Suparman.

But in his decision, Suparman said that if Rizieq Shihab later violated his statement as stated in the guarantee letter, the offline trial decision would be canceled.

"If the applicant violates the statement in the guarantee letter dated March 23, 2021, this determination will be reviewed," he said.

Rizieq Shihab was charged with incitement to the appearance of a crowd at his daughter's wedding as well as commemorating the Prophet's birthday in Petamburan, Central Jakarta. This crowd is taking place in the midst of the COVID-19 Pandemic.

"Doing, who orders to do and who participates in doing actions in public orally or in writing incites to commit a criminal act of health quarantine as referred to in Article 93 of Law Number 6 of 2018 concerning Health Canteen, committing violence against public authorities or disobeying both the provisions of the Law and a position order given is based on the provisions of the law, ”said the prosecutor reading the indictment.

According to prosecutors, Rizieq Shihab and Haris Ubaidillah, Ahmad Sabri Lubis, Ali Alwi Alatas, Idrus alias Idrus Al Habsyi and Maman Suryadi, incited incitement to the emergence of a crowd in Petamburan.
