The Supreme Court's Response To The 30 Year Cagub-Cawagub Age Requirement, PKS: Good, Young People Can Participate In The Pilkada

JAKARTA - PKS responded positively to the decision of the Supreme Court (MA) which granted the lawsuit of Garuda Party Chairman Ahmad Ridha Sabana, who had implications for changing Article 4 paragraph 1 letter d PKPU 9/2020 concerning the age requirements for candidates for governor and deputy governor candidates. Where regional head candidates may register for the Pilkada even though they are not even 30 years old. PKS DPP chairman Mardani Ali Sera assessed that the decision was good so that young people could participate in the Pilkada contestation. According to him, the KPU must comply with the Supreme Court's decision.

"The KPU must join the Supreme Court. It's good that young people can participate in the regional elections," Mardani told reporters, Friday, May 31.

The member of Commission II of the DPR admitted that there was no problem with the change in the policy. According to Mardani, Indonesia has many quality young people to lead the region.

"We have a lot of quality young people," he said.

It is known that the Supreme Court (MA) granted the request of the General Chairperson of the Garuda Party, Ahmad Ridha Sabana. This is related to the regulation of the age limit for regional heads of at least 30 years to be revoked.

The decision was contained in Decision Number 23 P/HUM/2024, which was decided by the Chairman of the Yulius Assembly, with Member of Assembly 1 Bright Bangun and Member of Assembly 2 Yodi Martono. For information, the minimum age limit for Cagub and Cawagub as stated in Article 4 Paragraph (1) letter d of General Election Commission Regulation (PKPU) Number 9 of 2020, the Supreme Court stated, is contrary to Law (UU) Number 10 of 2016.

From this decision, the Supreme Court has changed what was originally Cagub and Cawagub were at least 30 years old, which has been calculated since the appointment of candidates to be after the inauguration.

On that basis, the Supreme Court asked the KPU to revoke Article 4 Paragraph (1) letter d of PKPU Number 9 concerning the Nomination of the Election of Governors and Deputy Governors, Regents and Deputy Regents, and/or Mayors and Deputy Mayors.
