Youth From Solo Proposes Material Tests Related To Giving SIMs For Drivers Under 17 Years

SOLO- A man named Taufik Idharudin from Solo, Central Java, submitted a judicial review to the Constitutional Court (MK) regarding the granting of a driving license (SIM) to drivers under the age of 17.

Taufik was inspired by two children from Sampang, Madura, who managed to travel by driving two-wheeled vehicles 430 km to Semarang. Even though it was stopped by police officers, the skills and abilities of the young rider were considered equal to adults.

"I would like to submit an application regarding the judicial review of Article 81 Paragraph 2 Letter a of Law Number 22 Year 2009 concerning Road Traffic and Transportation of the 1945 Constitution, because I am amazed by the two children, namely the initials SZ aged 11 years and DR aged 10 years from Sampang, Madura," he said in Solo, Central Java, Saturday, April 20.

He said the two of them traveled by driving a two-wheeled vehicle from Sampang and planned to go to Jakarta. However, on their way to Semarang, they were stopped by police officers.

"I am amazed by their skills and skills because they are from Sampang to Semarang about 430 km, but they can be safe. This means that their skills and abilities are equal to people over the age of 17," he said.

He said that if the rules allow SIM to only be given to drivers with a minimum age of 17 years. "This means that with such abilities they should be able to get a driver's license because they have skills such as being over the age of 17 years," said the man who works as a private employee.

On the same occasion, the attorney representing Taufik, Sri Kalono said two days ago, on April 18, 2024, his party had submitted a request for material testing Article 81 Paragraph 2 Letter a of Law Number 22 Year 2009 concerning Road Traffic and Transportation of the 1945 Constitution which was contained in the State Gazette of the Republic of Indonesia of 2009 Number 96, namely throughout the age of 17 years for SIM A, SIM C, and SIM D contrary to the 1945 Constitution 45 years conditionally and has no binding legal force as long as it is not interpreted or has experience in driving a vehicle of at least 149 km.

"Our online registration has been submitted and has been accepted by the clerks of the Constitutional Court (MK)," he said.

He hopes that with this application in the future, all children under the age of 17 who have experience driving vehicles will be given a driving license. "Because article 81 paragraph 2 letter a limits the constitutional rights of children under 17 in driving motorized vehicles," he said.

Asked about the emotional maturity of drivers under 17 years old, according to him, the experience of the two children from Madura can be proof.

"From Madura to Semarang, it's a great achievement. The problem of maturity is proven by experience. That's why at least the conditions have taken a minimum of 149 km," he said.
