Otto Hasibuan: Allegations Of TSM Violations Should Be Referred To Bawaslu

JAKARTA - Deputy Chairman of the Prabowo-Gibran Defenders Team, Otto Hasibuan, assessed that the alleged structured, Systematic, and Massive (TSM) violations mentioned in the Ganjar-Mahfud legal team against Prabowo-Gibran should have been addressed to Bawaslu.

"It is true that there is Article 475 of the Election Law which stipulates that the dispute over the results of the presidential election is in the Constitutional Court, but if the TSM issue is in Bawaslu," Otto said after the preliminary hearing of the presidential election PHPU at the Constitutional Court, Jakarta, reported by ANTARA, Wednesday, March 27.

Otto assessed that Ganjar-Mahfud's legal team wanted the judge to make a breakthrough, but this was wrong because a new breakthrough could be taken if there were no applicable rules.

"Like the former case of TSM in 2014, there were no rules regarding TSM, so the Court took a breakthrough. Creating regulations regarding TSM violations," he said.

Otto said that now the TSM issue has been regulated in the Election Law, so according to him there is no more room for the Constitutional Court to take a breakthrough that is contrary to the existing legislation.

"We comply, the compliance of the Constitutional Court must be maintained in order to remain obedient to the applicable law and the procedural law that has been regulated in the law," he concluded.

It is known, in the petition submitted by the Ganjar-Mahfud legal team, it was stated that there were allegations of TSM violations in the form of nepotism that were used to win candidate pair 02 Prabowo-Gibran with one round.

Today, Wednesday, a preliminary hearing on the PHPU for the 2024 presidential election will be held which is divided into two sessions.

Case one, namely the application submitted by candidate pair number one Anies Baswedan and Muhaimin Iskandar with register number 1/PHPU.PRES-XXII/2024, will be held at 08.00 WIB-completed.

Meanwhile, case two, namely the application submitted by candidate pair number three Ganjar Pranowo and Mahfud Md with register number 2/PHPU.PRES-XXII/2024, will be held at 13.00 WIB-completed.

Then, the stages of the trial examination and the submission of the respondent's answer, information from related parties, and a statement were held on Thursday (28/3).

Next is the trial examination stage held on April 1-18, 2024 and the stage of the pronouncement of the verdict or stipulation will be held on April 22, 2024.
