Hary Tanoe's Company Whose Lawyer Is Hotman Paris Wins A Lawsuit From KT Corporation

JAKARTA - The company owned by Hary Tanoesoedibjo, PT Global Mediacom Tbk (BMTR) has won the appeal process over the bankruptcy application submitted by a company from South Korea, KT Corporation.

Quoted from the disclosure of information on the website of the Indonesia Stock Exchange (IDX), Wednesday 3 March, this application numbered case number 1435.K/ Pdt.Sus-Pailit/2020 and submitted to the Supreme Court was declared rejected at the cassation level on February 24, 2021. "Thus, as of the intended date the rejection of the bankruptcy petition has permanent legal force", wrote the management of the company owned by the 33rd richest person in Indonesia.

Previously, KT Corporation filed for bankruptcy against Global Mediacom on July 28, 2020, and received case number 33/Pdt.Sus-Pailit/2020/PN Niaga Jkt.Pst. In its decision, Global Mediacom won the bankruptcy lawsuit from the South Korean telecommunications company.

Global Mediacom's attorney, Hotman Paris Hutapea, said that his team succeeded in winning the lawsuit, so the bankruptcy lawsuit filed by KT against Global Mediacom was rejected by the Central Jakarta District Court.

At that time, Christophorus Taufik, Global Mediacom Legal Director, said that the petition was groundless or invalid because the agreement on which the application was based had been canceled based on the decision of the South Jakarta District Court No. 97/Pdt.G/2017/PN.Jak.Sel dated May 4, 2017, which has permanent legal force.

"That the applicant submitted the Application is the KT Corporation whose validity should be questioned, considering that in 2003 the one associated with the Company was KT Freetel Co. Ltd, and then in 2006 the relationship was transferred to PT KTF Indonesia", said Christophorus.

He revealed that this case was more than 10 years old. Previously, KT Corporation submitted a request for reconsideration to the Supreme Court and was rejected based on the Supreme Court decision No. 104PK/Pdt.G/2019 dated 27 March 2019.
