Ambon District Court Judge Sentenced To 7 Years In Prison Defendant Of Child Raping

AMBON - The panel of judges at the Ambon District Court, Maluku, sentencedUL Komul (22) to seven years in prison, a defendant in a case of rape and sexual intercourse of a minor.

"Declaring that the defendant is guilty of violating Article 81 Paragraph (2) of the Republic of Indonesia Law Number 17 of 2016 concerning the Determination of Perppu Number 1 of 2016 concerning the Second Amendment to Law Number 23 of 2002 concerning Child Protection," said Chief Justice Martha Maitimu when reading the verdict at the Ambon District Court as reported by ANTARA, Monday, March 25.

The defendant Komul was also sentenced to pay a fine of Rp. 60 million, subsidiary to six months in prison.

The judge said that the aggravating thing was that the defendant was sentenced to prison and paid a fine because his actions were committed against the victim, who was a minor and his family felt ashamed. While the mitigating thing is that the defendant is polite and has never been convicted.

The judge's decision was still lighter than the demands of the Public Prosecutor of the Ambon District Attorney, Endang Anjada, who in the previous trial demanded that the defendant be sentenced to nine years in prison and pay a fine of Rp. 50 million, subsidiary to three months in prison.

Based on the decision of the panel of judges, both the prosecutor and the defendant through their legal advisors expressed their thoughts.

The 22-year-old Coup defendant is a resident of Haria Country, Saparua District, Central Maluku Regency.

The alleged rape crime committed by the defendant occurred on November 19, 2023 near a water reservoir in the five countries of Haria, Saparua District, Central Maluku.

The victim had just returned from his friend's house with a presentation with the defendant in the middle of the road, then the defendant deliberately asked the victim for money.

However, the victim replied that he had no money. The defendant then immediately pulled the victim's underage hand towards the scene and forced sex with him.

After that, the defendant immediately returned home, while the victim who did not receive it immediately reported the incident to his parents and forwarded it to the local police.
