Six Defendants Of KKT Fictitious SPPD Corruption Sentenced To 1.5 Years- 5 Years In Prison

AMBON - Ambon's panel of judges for corruption (Tipikor) sentenced six defendants to corruption in the fictitious official travel order (SPPD) to the Regional Financial and Asset Management Agency (BPKAD) of the Tanimbar Islands, Maluku.

Six corruption defendants in the 2020 fictitious official travel budget corruption case that cost the state Rp6 billion, including Jonas Batlayery, former Head of BPKAD KKT, Maria Goretti Batlayeri, Letarius Erwin Layan, Ati Malirmasele, Klementina Oratmangun and Kristina Sermatang.

"Declaring that the defendant Jonas Batlayery was proven to have violated Article 2 and Article 3 of Law Number 20 of 2001 concerning amendments to Law Number 31 of 1999 concerning the criminal act of corruption Juncto Article 55 of the 1st KHUP as a primary indictment," said Chairman of the Ambon Corruption Panel of Judges Haris Tewa accompanied by two member judges, in Ambon reported by ANTARA, Monday, February 19.

In its ruling, the panel of judges also sentenced the defendant to pay a fine of Rp. 200 million, subsidiary to two months in prison and compensation of Rp. 5 billion, subsidiary to one year and six months in prison.

Then, the defendants Maria Goretti Batlayeri, Letarius Erwin Layan, Ati Malirmasele, Klementina Oratmangun and Kristina Sermatang who were included in the case file were sentenced to 1.5 years in prison.

The five defendants were not sentenced to pay replacement money because they were all charged to the defendant Jonas Batlayery.

In this case, the defendant Jonas has returned Rp1 billion plus Rp350 million which was returned by a witness who is an auditor from the BPKP RI Representative for Maluku Province.

There are also things that are burdensome for the defendants to be sentenced to prison because the state civil apparatus does not support the government's program in eradicating corruption.

Meanwhile, what relieves the defendants to be polite and admit their actions, have returned some of the state's money, and the defendants have family responsibilities.

Based on this decision, both the Public Prosecutor's Office of the Tanimbar Islands and the defendants through their legal advisory team expressed their thoughts on filing an appeal.

In the previous trial, the defendant Jonas was sentenced to eight years in prison, a fine of Rp. 350 million, subsidiary to three months in prison and compensation of Rp. 1.2 billion, subsidiary to four years in prison.

Meanwhile, the defendants Kristina Sermatang and Maria Goreti were each sentenced to seven years in prison and a fine of Rp. 300 million, subsidiary to three months in prison.

The defendant Kristina Sermatang, treasurer of BPKAD KKT 2020 expenditure, was required to pay compensation of Rp193.1 million, subsidiary of 3.5 years in prison, and Maria Goreti as Secretary of BPKAD KKT 2020 was also required to pay compensation of Rp665.4 million, subsidiary of 3.5 years in prison.

Meanwhile, the defendants Klemen Yoan Oratmangun, Liberata Malirmasele and Letarius Erwin Layan were sentenced to the same prison sentence, namely six years in prison each and a fine of Rp250 million, subsidiary to three months in prison.

The defendant Klemen was required to pay compensation of Rp. 788.8 subsidiary three years in prison, Liberata Mairmasele Rp. 251.7 million, subsidiary to three years in prison and Letarius Erwin was required to pay compensation of Rp. 351.3 million, subsidiary to three years in prison.
