Menkumham Regarding The Status Of Suspect Eddy Hiariej Is Not Valid: Respect The Court's Decision, It's Up To The KPK To Follow Up

JAKARTA - Minister of Law and Human Rights (Menkumham) Yasonna H. Laoly responded to the decision of the South Jakarta District Court regarding the determination of the suspect against the former Deputy Minister of Law and Human Rights (Wamenkumham) Edward Omar Sharif Hiariej (EOSH) alias Eddy Hiariej.

Yasonna said that the party respects the decision of the South Jakarta District Court and submits the next legal process to the Corruption Eradication Commission (KPK).

"We just respect the court's decision, it's up to how the KPK will follow up, legally that's how the court decides," Yasonna said as quoted by ANTARA, Tuesday, January 30.

However, continued Yasonna, court decisions cannot be contested.

"The court's business, how can we interfere. That's a court matter. It has been decided by the court, right," said the Minister of Law and Human Rights.

The judge of the South Jakarta District Court decided that the determination of the suspect against Eddy Hiariej by the KPK was invalid. This was decided by the sole judge, Estiono, in a hearing to read the verdict held at the South Jakarta District Court, Jakarta, Tuesday.

"Declaring the determination of the suspect by the respondent (KPK), as referred to in Article 12 letter a or Article 12 letter b or Article 11 of Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption, as amended by Law Number 20 of 2021 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph 1 to 1 of the Criminal Code in conjunction with Article 64 paragraph (1) of the Criminal Code against applicants (Eddy Hiariej) is invalid and has no binding legal force," said Estiono.

Thus, the determination of the suspect against Eddy Hiariej in the alleged bribery case of administrative management without going through procedures at the Ministry of Law and Human Rights does not have binding legal force.

"In the exception, it states that the defendant's exception is unacceptable," said Estiono.

Eddy Hiariej is one of the suspects named by KPK investigators in the alleged bribery case for administrative management without going through procedures at the Ministry of Law and Human Rights.

Apart from Eddy Hiariej, the other suspects are lawyer Yosi Andika Mulyadi (YAM) and personal assistant EOSH Yogi Arie Rukmana (YAR). Meanwhile, another person, the President Director of PT Citra Lampia Mandiri (CLM) Helmut Hermawan (HH) has been detained by the KPK.
