JAKARTA - The DKI DPRD received rejection from the Ministry of Home Affairs (Kemendagri) when proposing an additional time for the approval of the 2020 DKI Regional Revenue and Expenditure Budget (APBD). The deadline it has is only until November 30.
Director General of Regional Finance at the Ministry of Home Affairs, Syarifuddin, explained that it was impossible for him to allow additional time outside of the provisions of Government Regulation (PP) Number 12 of 2019 concerning Regional Management.
In Article 106 PP 12/2019, the Governor and DPRD are required to approve the finalization of the draft APBD no later than 1 month before the start of the fiscal year. Given, there needs to be a further evaluation from the Ministry of Home Affairs before the APBD is knocked into a Regional Regulation (Perda) on the 2020 DKI Regional Budget.
"The laws and regulations never mention an extension of time. If it is more than November 30, it means that the name of the APBD approval is not timely," Syarifuddin told reporters, Friday, November 22.
If the APBD has not been approved by the end of November, of course there will be implications in the form of sanctions. These sanctions are administrative in nature in accordance with statutory provisions.
Even so, PP 12/2019 apparently did not state what sanctions would be imposed. Meanwhile, these sanctions are regulated in PP 12 of 2017.
It turns out that the choice of administrative sanctions that will be received by the DPRD and the DKI Provincial Government in Article 37 PP 12/2019 is not only a delay in the payment of financial rights (salaries) for 6 months.
There are other sanctions such as only written warnings, withholding of 3 months salary, postponement of profit sharing funds, obligation to participate in government development programs, to severe sanctions, namely dismissal.
"The PP already exists, PP 12 of 2017, but that's why the Ministry of Home Affairs still needs to evaluate why it is late, if the cause is between the regional head then the regional head will be sanctioned. If the cause is DPRD, then the sanction is on the DPRD," explained Syarifuddin.
Contacted separately, DKI DPRD Deputy Chairman Muhammad Taufik responded to the rejection of the extension of the APBD ratification until December 15th.
Even though he was rejected, he also could not force the DKI Jakarta Regional Budget to be finalized on November 30. Bearing in mind, the discussion on general policy on the temporary budget priority-ceiling (KUA-PPAS) was only held on 23 October.
This is because the board fittings (AKD) for the 2019-2024 period were only formed on October 21. that is what caused the budget discussion to be delayed from schedule.
"Yes, what do you want to do? The provisions are November 30, but (the discussion is delayed) because there is an election situation. Besides, we have to go through the discussion process, the important thing is not until the end of the year," said Taufik in a telephone connection. .
Regarding administrative sanctions for not ratifying the draft APBD on November 30, he admitted that this would not be a problem. In fact, if you have to experience a salary delay for six months, as experienced several years before.
"It doesn't matter if you want to apply sanctions, just apply them. It's not pay, it's okay, it's only in the dirapel," he said.
