JAKARTA - The Indonesian Anti-Corruption Society (MAKI) filed a pretrial against the Corruption Eradication Commission (KPK) regarding the bribery case for the provision of social assistance (bansos).
"Today, MAKI has registered a pretrial against the KPK for neglecting the handling of the social assistance corruption case of the Ministry of Social Affairs," said MAKI Coordinator Boyamin Saiman in his written statement, Friday, February 19.
The lawsuit, which was filed at the South Jakarta District Court, was carried out because the KPK allegedly did not carry out about 20 search permits that were granted by the KPK Supervisory Board regarding the case that charged former Social Minister Juliari Peter Batubara.
The demand was also filed because the KPK had not yet summoned the PDIP politician, Ihsan Yunus. In fact, said Boyamin, investigators had searched the house of Ihsan Yunus 'parents, summoned Ihsan Yunus' younger brother, Muhammad Rakyan Ikram and his operator, Agustri Yogasmara as witnesses.
Not only that, the KPK has carried out reconstruction twice and it is clear that Ihsan Yunus is connected in the case.
"Investigators have carried out a series of activities related to Ihsan Yunus. However, until now there has never been reported on the summoning and examination as a witness so it should be suspected that the KPK is not professional," he said.
As a result of ignoring the search permit and Ihsan Yunus' not having been examined, three suspects who received bribes, namely former social minister Juliari Peter Batubara and two Commitment Making Officials (PPK) at the Ministry of Social Affairs Matheus Joko Santoso and Adi Wahyono have not completed the case files.
"So that the case files cannot be submitted for immediate trial," he said.
Furthermore, Boyamin said, this condition is a form of terminating case investigation in a material, secretive, hanging, and causing legal uncertainty for other suspects.
So, in his lawsuit, MAKI asked the KPK to immediately conduct a search as the 20 permits had been issued by Dewas and summoned Ihsan Yunus. Not only that, this anti-corruption activist also asked the KPK to immediately complete the investigation and hand over the case files to the public prosecutor.
Previously, the KPK named a number of suspects in connection with the alleged corruption case of social assistance (bansos) food packages for the handling of COVID-19 in the Jabodetabek area including the non-active Social Minister Juliari Batubara.
Apart from Juliari, the KPK also named four other suspects, namely the Commitment Making Officer at the Ministry of Social Affairs (PPK) MJS and AW as recipients of bribes and AIM and HS as the givers of bribes.
In investigating this case, the name of the former Commission VIII DPR RI Ihsan Yunus later appeared. He is suspected of having participated in the meeting to discuss this procurement project at the Ministry of Social Affairs Office.
In addition, through his operator, he allegedly received money of IDR 1.53 billion and two units of Brompton folding bicycles. This giving was made by Harry Sidabuke who was the bribe giver for Juliari Batubara, cs and was accepted by Agustri Yogasmara.
