Case Stopped, Killer Of Animal Thief In Serang Declared Free

SERANG - The Serang District Attorney's Office (Kejari) has stopped the case that happened to Muhyani, who was previously named a suspect. Muhyani killed the animal thief with the initials W in the rice fields.

The Decree on the Termination of Prosecution (SKP2) was issued by Kajari Serang after the exposure (case) was carried out at the Banten Prosecutor's Office.

"The results of the exposure are all agreed that the case of an MUHYANI Bin SUBRATA is not appropriate to be transferred to court," said Kajati Banten Didik Farkhan in a statement seen on Sunday, December 16.

"Based on the facts of the actions excavated by the Public Prosecutor, it was found that there had been a 'noodweer' as referred to in Article 49 Paragraph (1) of the Criminal Code," he continued.

On that occasion, Didik explained that the article explained that it was related to the criminal act committed by Muhyani because the defense act was forced, both to himself and to other people's property.

"Because there are attacks or threats when it is against the law, against yourself or others," he said.

Meanwhile, based on the results of the post-mortem at the Bhayangkara Hospital, the Banten Police, on March 14, 2023, concluded that the victim or thief with the initials W, died from bleeding.

"From the results of Visum et Repertum, it can be concluded that the victim was not declared dead directly because of Muhyani's act of stabbing scissors into the victim's chest, but the victim died of bleeding and did not immediately get help," he explained.

"That in the case file it was revealed that MUHYANI Bin SUBRATA as a goatkeeper, based on Article 49 paragraph (1) the Criminal Code was able to defend itself and other people's property," he explained.

The persecution by Muhyani (58) against a thief actually led to problems for him. Muhyani was arrested by the police and named a suspect for molesting a goat thief belonging to her employer in Serang, Banten.

The determination of the suspect was also issued by the Serang City Police with the number: S.Tap/117/IX/RES 1.6/2023/Reskrim dated September 19, 2023. Muhyani has been officially named a suspect in Article 351 paragraph 3 of the Criminal Code since September 15, 2023.

The head of RT Nuraen said that Muhyani's persecution took place in February 2023. Muhyani, who at that time wanted to go to the fields, accidentally caught a thief taking his employer's goat in the cage.

"The thief took out a machete from the waist. But Mr. Muhyani first stabbed the perpetrator with scissors which is usually used to pick fruit. Maybe for him, rather than being attacked first, so he defended himself, attacked first," said Nuraen, Tuesday, December 12.

After carrying out the stabbing, Muhyani also shouted for help, so the thief fled. Residents who heard immediately arrived. However, the thief disappeared without a trace.

"When it was 6 a.m., there were gentlemen going to the rice fields, he found a corpse, then I arrived when it turned out to be a neighbor next door (the body of the thief who was stabbed in the scissors by Muhyani)," he added.
