3 Files Of Rizieq Shihab's Case Complete And Ready For Trial

JAKARTA - The Attorney General's Office (Kejagung) has stated that all the case files with the suspect Rizieq Shihab is complete or P21.

The three cases include cases of suspected violation of the Petamburan, Megamendung, and suspected cases of obstructing the work of the COVID-19 Task Force at the Bogor Ummi Hospital.

Director of General Crimes at Bareskrim Polri, Brigadier General Andi Rian said that all the case files were declared complete after being handed over again. This is because previously the investigating prosecutor had judged the case file to be incomplete from both a formal and a material perspective.

"Everything is P21, including the case files for the Bogor Ummi Hospital", Andi told reporters, Monday, February 8.

However, Andi did not specify when the case file was declared complete by the Attorney General's Office. Apart from that, with the complete case files, Rizieq will be tried on these three cases.

Previously it was reported that the Police Criminal Investigation Unit would carry out stage 2 cases of suspected violation of health protocols in Petamburan. The suspect Rizieq Shihab and his evidence will be submitted to the Attorney General's Office for immediate trial.

"The responsibility of the suspect and the evidence (handed over) from the investigators of the Criminal Investigation Unit of the National Police to the public prosecutor", said Karo Penmas, Police Public Relations Division, Brigadier General Rusdi Hartono, to reporters, Friday, February 5.

This second handover, said Rusdi, after the research prosecutor stated that the case files were complete, both from a formal and material side. The plan is for Rizieq to be handed over to the Attorney General's Office on Tuesday, February 9.

"The case file in question is already P21, declared complete by the prosecutor", he explained.

In the crowd case in Petamburan, Rizieq Shihab was named a suspect along with five other suspects on November 14, 2020.

He is suspected of violating Article 160 of the Criminal Code concerning incitement to the public to commit a criminal act resulting in a health emergency in the community.

Apart from that, the high priest of FPI is also suspected of violating Article 216 of the Criminal Code which states that there is no compliance with the law. Meanwhile, the case involving the Main Director of the Bogor City UMMI Hospital, Doctors Andi Tatat, and Rizieq Shihab.

In this case, they are suspected of Article 14 and/or Article 15 of Law Number 1 of 1946 concerning Criminal Law Regulations and/or Article 14 Paragraph (1) and Paragraph (2) of Law Number 4 of 1984 concerning Contagious Disease Outbreaks and/or Article 216 Criminal Code Jo. Article 55 KUHP and/or Article 56 KUHP.

Then, the case file for the alleged violation of the health protocol in Megamendung, Bogor with the suspect Rizieq Shihab. In this case, Rizieq is alleged to have violated Article 14 paragraph (1) and paragraph (2) of Law Number 4 of 1984 concerning Contagious Disease Outbreaks and/or Article 93 of Law Number 6 of 2018 concerning Health Quarantine and/or Article 216 of the Criminal Code.
