KPK Sends Former Garuda Indonesia Boss Emirsyah Satar To Sukamiskin Prison

JAKARTA - The Corruption Eradication Commission (KPK) executed former boss of PT Garuda Indonesia, Emirsyah Satar, at the Sukamiskin Prison, Bandung, West Java. He was executed after being convicted of corruption in the procurement and maintenance of the state-owned airline.

This execution was carried out based on the Decision of the Corruption District Court at the Central Jakarta District Court 121 / Pid.Sus / TPK / 2019 / PN.Jkt.Pst dated 8 May 2020 in conjunction with the Corruption Court Decision at PT DKI Jakarta Number: 19 /Pid.Sus-TPK/2020 / PT DKI dated 17 July 2020 Jo Decision MA Number: 4792 K / Pid.Sus / 2020 dated 23 December 2020.

"The Team of Prosecutors for the Execution of the KPK on Wednesday, February 3 carried out the execution of the convicted body criminal Emirsyah Satar," said Acting KPK spokesman for prosecution Ali Fikri in his written statement, Friday, February 5.

Furthermore, Emirsyah will carry out a sentence of eight years reduced while in detention and the obligation to pay a fine of Rp1 billion on the condition that if the fine is not paid then it is replaced by imprisonment for three months.

In addition, it was also charged to pay replacement money in the amount of 2,117,315.27 Singapore dollars. "Provided that if they do not pay within one month after the court decision has permanent legal force, the property will be confiscated and auctioned off to cover the replacement money," he explained.

If the property is not sufficient to pay the replacement money, Emirsyah must carry out a criminal sentence of two years.

Previously reported, the DKI Jakarta High Court has issued a verdict which strengthens the verdict handed down by the Corruption Court at the Central Jakarta District Court against the former President Director of PT Garuda Indonesia, Emirsyah Satar.

"Strengthening the verdict of the Corruption Court at the Central Jakarta District Court on May 8, 2020 Number 121 / Pid.Sus-Tpk / 2019 / PN.Jkt.Pst which was requested for the appeal," reads decision Number 19 / Pid.Sus-TPK / 2020. /PT.DKI uploaded on the MA website.

Based on this ruling, the panel of judges handling the appeal submitted by Emirsyah said the eight-year sentence and a fine of Rp1 billion, a subsidiary of three months in prison, imposed by the Corruption Court were in accordance with Emirsyah's mistakes and public justice.

Apart from that, the panel of judges also considered that Emirsyah had nothing new in the appeal memory and additional appeal memory.

The decision of PT DKI Jakarta also strengthens the verdict handed down by the Corruption Court against the former President Director of PT Mugi Rekso Abadi Soetikno Soedarjo. Both have the same status as defendants in the bribery and TPPU cases.

In the verdict of the Corruption Court, Emirsyah Satar was declared legally and convincingly proven to have committed a criminal act of corruption in the procurement and maintenance of Garuda Indonesia aircraft.

He was also found guilty of committing the crime of money laundering in accordance with Article 3 of the TPPU Law jo. Article 55 paragraph 1 to 1 and Article 65 (1) KUHP.
