JAKARTA - The government through the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) will soon enforce new regulations regarding proof of land ownership. Later all original or old land certificates will be withdrawn and replaced by electronic means.

This is stipulated in the Regulation of the Minister of ATR/Head of BPN Number 1 of 2021 concerning Electronic Certificates which were only signed on January 12, 2021. This means that proof of ownership of a land certificate or land book will no longer be made of paper, but rather an electronic land certificate whose data is included in the land system.

This program is the government's effort to realize the modernization of land services in order to improve indicators of ease of doing business and public services to the community. Therefore, it is necessary to optimize the use of information and communication technology by implementing electronic-based land services.

The regulation states that all land ownership registrations will be carried out electronically since the regulation came into force. So all processes will be validated first with previous land certificates, in terms of data, land size, and so on.

After the validation is complete and finished, then the land certificate can be replaced with an electronic certificate. Later, the certificates will be stored in the database electronically to their respective storage addresses.

"The issuance of an electronic certificate for the first time is carried out through the first land registration for unregistered land or the replacement of the certificate into an electronic certificate for land that has already been registered," said Article 6 in the regulation, Wednesday, February 3.

Along with this provision, land ownership certificates in the form of land books will no longer be valid. This is because the electronic land certificate includes data and information that has been in the land book, measuring documents and flat plan drawings.

Therefore, once the owner has an electronic certificate, the proof of ownership in paper will be withdrawn by the Land Office. Furthermore, the data will be transferred alias scanned, and stored in a database or electronic land system.

"The Head of the Land Office withdraws the certificate to be combined with the land book and stored as a document at the Land Office," writes Article 16 paragraph 3.

If later there is a change in data and information in the electronic certificate, the process will also be carried out electronically.

The following is the content in Article 16, namely:

(1) Replacement of a certificate to an e-certificate includes the replacement of a land book, measuring document, and/or a drawing of a flat unit plan into an electronic document.

(2) Replacement of e-certificate as referred to in paragraph (1) shall be recorded in the land book, measurement letter, and/or flat plan drawing.

(3) The Head of the Land Office shall withdraw the certificate to be combined with the land book and stored as a document at the Land Office.

(4) All documents as referred to in paragraph (3) shall be scanned and stored in the Database.
