Mulyadi Sues The Issue Of Determination Of Suspects, West Sumatra KPU Affirms The Court Has No Authority To Judge

PADANG - Attorney General Election Commission of West Sumatra (West Sumatra) assessed that the Constitutional Court (MK) is not authorized to examine, try and decide the lawsuit submitted by the candidate for governor of West Sumatra Mulyadi to the MK. The reason is that the lawsuit filed by Mulyadi is not a matter of determining the vote acquisition.

"The Constitutional Court is not authorized to examine, judge and decide cases filed because what is being sued is an unfair law enforcement process imposed by an integrated law enforcement center," said West Sumatra KPU legal attorney, Sudi Prayitno in the continued trial of the 2020 simultaneous regional election results dispute at the MK, quoted by Antara. , Monday, February 1.

Sudi conveyed this when reading out his response as the defendant in case 129 / PHP.GUB-XIX / 2021 led by Constitutional Justices Anwar Usman, Wahiduddin Adams and Enny Nurbaningsih.

According to him, the lawsuit submitted by the cagub Mulyadi better qualify for violations of the election organizer's code of ethics which is the authority of the Election Organizer Honorary Council.

KPK attorneys said that the candidate for governor of West Sumatra Mulyadi also did not have a legal position to apply for PHPU for the 2020 West Sumatra Pilgub, because he had a difference of 112,406 votes with the most votes.

"This is above the threshold of votes allowed by law to submit applications, namely 33,602 votes," he said.

In addition, the KPK attorney also assessed that Cagub Mulyadi's petition was unclear on what was the main point of his claim and did not elaborate on the arguments on which the petition was based.

"The petitioner's demand has never asked the Court to determine the correct vote count results according to the applicant, and the demand for re-election is not included with strong reasons," said Sudi.

Previously, during the inaugural trial of the West Sumatra Pilgub lawsuit, Mulyadi felt that he was wronged for the determination of the status of an election criminal suspect so that it affected his vote acquisition in the West Sumatra Pilgub.

"The implementation of the 2020 West Sumatra Governor Election is far from the principle of being honest and fair, three days before the election I was named a suspect, this is really detrimental to our hearts," said Mulyadi.

According to Mulyadi, the efforts he has initiated so far have collapsed and delegitimized public trust in him amidst rising electability.

"The news that I was declared a suspect was also spread massively by interested parties on social, print and electronic media," he said.

In line with that Mulyadi's attorney, Veri Junaidi, asked the Constitutional Court to cancel the West Sumatra KPU's decision regarding the results of the West Sumatra Pilgub conducted by the West Sumatra KPU.
