Article About Sadism In The Bill On Family Resilience Considered Unnecessary

JAKARTA - The Family Resilience Bill (RUU) proposed by the DPR is considered to curb women. This bill is planned to be included in the 2020 Priority National Legislation Program (Prolegnas).

Komnas Perempuan Commissioner Bahrul Fuad regretted the presence of this bill. For him, to maintain family resilience, there is no need to use this bill. This is because there are laws (UU) that have the same objectives as this bill, including the Law on Marriage, the Law on the Elimination of Domestic Violence (PKDRT), the Compilation of Islamic Law, and even the discussion of the Bill on the Elimination of Sexual Violence (PKS).

Furthermore, Bahrul assessed, when the Bill on Family Resilience was passed, it would overlap with other regulations.

"The existing law is the spirit for family resilience. So discussing this bill is a waste of time. It is a waste of energy. In substance, the Bill on Family Resilience has been regulated in the previous Law," he said, when contacted by VOI, in Jakarta, Thursday , February 20.

Bahrul highlighted a number of articles deemed inappropriate in the Family Resilience Bill. One of them is the article on sadism which has been regulated in another law.

Article 85: The agency that deals with Family Resilience is obliged to carry out handling of Family Crisis due to sexual deviance as referred to in Article 74 paragraph (3) letter f in the form of: a. social rehabilitation; b. psychological rehabilitation; c. spiritual guidance; and / or d. medical rehabilitation.

Elucidation of article Article 85

Paragraph (1) What is meant by "sexual deviance" is sexual urge and satisfaction that is shown unusual or in unreasonable ways, including among others: a. Sadism is a person's way of getting sexual satisfaction by punishing or hurting the opposite sex. Masochism, as opposed to sadism, is a person's way of obtaining sexual satisfaction through punishment or torture from the opposite sex. C. Homosex (men and men) and lesbians (women and women) are social identity issues where someone loves or likes other people of the same gender. Incest is a sexual relationship that occurs between people who have blood relations in a straight line down, upward, or sideways, by the same age, sexual relations, and relationships that are prohibited by their religion or other applicable regulations.

According to Bahrul, this article is unnecessary. Because, this has been regulated in Law number 23 of 2004 concerning the Elimination of Domestic Violence (PKDRT) and the Criminal Code.

He added, rather than passing the Family Resilience Bill, it would be better for the DPR to immediately pass the Bill on the Elimination of Sexual Violence (PKS).

"Yes (no need for the Family Resilience Bill). It is more important that the PKS Bill is passed. The PKS Bill actually regulates how this family resilience is built. The values in the PKS Bill also contribute to building quality Indonesian people. So that it will produce offspring. which was successful for Indonesia, "he explained.

The Proposer for the Family Resilience Bill, Ali Taher considered that the pros and cons of the proposed bill were reasonable. However, if we reflect on social reality, in fact, the current objective condition is the fragility of society in the world of marriage.

This PAN politician said, this bill departs from the main problem of the family, as well as how the regulation provides protection, guarantee, and legal certainty for husband and wife in the event of domestic violence.

He added, the inclusion of the phrase 'sadime' in the Bill on Family Resilience was due to reflecting on a case experienced by a wife in Bengkulu who experienced violence from her husband and led to death because she did not reveal the contents of her device to her husband.

"We discuss the substance continuously. Inputs, recommendations, suggestions from the community are still open for us to discuss. So we are always open. So there are no suggestions yet, it is still in process," he said.

Ali admits that he has no objection if the bill is rejected by many parties during the process. Because, from the beginning the intention to propose this bill was to care about the condition of women.

"That's the personal part with other people, right? I see, when I met Mrs. Yohana (PPA Minister) at that time, it was a matter of household communication that was not going well. Don't you see that this is as if this law is a law of Islamic law or laws that have a particular interest. Nothing, "he said.

"Because Law number 1 of 1974 on Marriage is unable to achieve that," he said.
