JAKARTA - South Jakarta District Court (PN) Sole Judge Alimin Ribut Sujono rejected the pretrial lawsuit of Supreme Court Secretary (MA) Hasbi Hasan, a suspect in the alleged bribery case handling the case in the Supreme Court.
"Rejecting, in the main case, the petitioner's pretrial application (Hasbi Hasan)," said Judge Alimin while reading out the pretrial decision at the trial at the South Jakarta District Court, reported by ANTARA, Monday, July 10.
The judge rejected Hasbi Hasan's lawsuit against the Corruption Eradication Commission (KPK) because he considered that the determination of the suspect against him was in accordance with applicable legal provisions.
"The determination of the applicant (Hasbi Hasan) as a suspect is in accordance with the existing provisions, namely at least two valid pieces of evidence," said Judge Alimin.
Hasbi Hasan filed a pretrial lawsuit at the South Jakarta District Court on Friday (26/5). The lawsuit with Case Number and Letter Number 49/Pid.Pra/2023/PN JKT.SEL sued whether or not the KPK had named a suspect against him.
Quoted from the Case Tracking Information System (SIPP) page of the South Jakarta District Court, one of the contents of Hasbi Hasan's petition is "Declaring that all decisions or determinations issued further by the respondent (KPK) related to the investigation carried out by the respondent and the determination of the suspect against the applicant (Hasbi Hasan) by the respondent."
Regarding the rejection of the pretrial lawsuit, Maqdir Ismail, Hasbi Hasan's attorney said that his party believed that the determination of the suspect against his client was invalid.
"The judge considers that preliminary evidence already exists, while we consider it non-existent because, in our opinion, preliminary evidence regarding bribery must be evidence related to bribery, not statements from people who say there is bribery," said Maqdir.
"I think, yes, we'll see if this will be proven in court or not," he continued.
