The Banda Aceh Police Criminal Investigation Unit has named one suspect in the alleged corruption case in the land acquisition of Zikr Nurul Arafah Islamic Center in Gampong Ulee Lheue, Meuraxa District, Banda Aceh City.

"From the results of the case title and sufficient evidence, we were able to determine the suspect," said Head of Criminal Investigation Unit of the Banda Aceh Police, Kompol Fadillah Aditya Pratama, as reported by ANTARA, Thursday, June 22.

Fadillah said that the suspects in the procurement project sourced from the Regional Revenue and Expenditure Budget (APBD) of the Banda Aceh City PUPR Office for the 2018 and 2019 fiscal years were SH as the former Head of the Ulee Lheue Gampong Government who served from 2016 to 2021.

The determination of SH as a suspect was carried out by investigators after the case was held on Tuesday (20/6).

"In the future, we will complete other evidence for the involvement of other suspects. The suspect SH has not yet been detained," he said.

In the case title, several facts were found that there were allegations of corruption in the procurement of zikr land with a total budget ceiling value of more than Rp. 5.1 billion (in 2018 worth more than Rp. 3.2 billion and in 2019 worth more than Rp. 1.8 billion).

Where, said Fadillah, in 2018, the land has been measured by the Banda Aceh City BPN according to detailed field measurements issued in May 2018. Then, the public appraisal service office (KJPP) also assessed the price of each land which results were issued in August 2018.

After the results of measurements and price assessments of 14 existing land parcels, the Banda Aceh City PUPR Office has paid nine land parcels with a total of more than Rp. 4 billion (five parcels in 2018 paid in more than Rp. 3.1 billion and four parcels in 2019 paid for more than Rp. 799 million).

The nine parcels of land indicated irregularities, of which three were land in Batu Ring Market, gampong land and land from one of the residents. Two of them use the rights base in the form of a Certificate of Land Owned by Gampong (SKT) and the other uses a sporadic rights base.

During the land payment process, the keuchik (village head) did not attach a gampong cash account, but a personal account.

"The agency did not verify in detail so that the land acquisition funds entered a personal account, even though according to the rules it should go into the gampong cash," he said.

From the results of an audit by the Aceh Financial and Development Supervisory Agency (BPKP), it is known that there was a state loss of more than Rp. 1 billion in the case.

"We will complete other evidence related to other suspects, including examining the suspect and completing the case file," he said.

In addition, his party has also confiscated the land based on the Determination of the Banda Aceh District Court Number: 4/Pen.Pid.Sus-TPK-SITA/2023/PN Bna dated February 13, 2023 and the Order to Confiscate the Criminal Investigation Unit of the Banda Aceh Police Number: SP/Sita/24/II/Res.3.5/2023/Sat Reskrim dated February 15, 2023.

Investigators have also confiscated evidence related to the management of the land compensation funds, including land, because from the results of the examination of witnesses and other evidence, some of the land compensation funds have been used to buy replacement land.

"The suspect is subject to Article 2 Paragraph (1) in conjunction with Article 3 in conjunction with Article 8 in conjunction with Article 18 paragraph (1) and (2) of Law of the Republic of Indonesia Number 31 of 1999 as amended by Law of the Republic of Indonesia Number 20 of 2001 concerning Eradication of Criminal Acts of Corruption," said Kompol Fadillah.
