The Last Bastion Of Democracy, Perludem Asks For The Integrity Of The Constitutional Court To Resolve 132 Cases Of Regional Election Disputes

JAKARTA - The Constitutional Court (MK) has begun holding a trial for the 2020 Pilkada dispute, Monday, January 26 today. The Association for Elections and Democracy (Perludem) asked the Constitutional Court Panel of Judges to uphold the integrity of the resolution of 132 cases of dispute over vote results.

"Perludem asks the Constitutional Court to be the protector of democracy and ensure that every process and outcome of the regional elections are obtained from processes with integrity," said Perludem Executive Director Khoirunnisa Agustyati in his statement, Tuesday, January 26.

In fact, said Khoirunnisa, the dispute process in the Constitutional Court was a constitutional mechanism to test the implementation process and the results of the elections were in accordance with election principles and the applicable legal framework.

"Apart from the applicant's interest in fighting for his rights, for election organizers, the process at the Constitutional Court can be used as a forum to prove that the process and results of the elections being carried out are a series of processes that are accountable," said Khoirunnisa.

According to Khoirunnisa, the series of case investigations carried out by the Constitutional Court is the last hope of democracy which is expected to guarantee justice and people's sovereignty over the results of the Pilkada.

"Therefore, the petitioner, respondent, related parties, constitutional judges, clerks, and all court proceedings at the Court must ensure that all processes at the Court will be carried out professionally, honestly and fairly," he said.

Khoirunnisa also asked the panel of judges, clerks, court officials, and the entire support system in the Constitutional Court to anticipate actions and actions that could damage the integrity of the Court.

Furthermore, Perludem also encouraged the Constitutional Court not to only look at, examine, and decide on variable disputes over figures in deciding disputes over regional election results.

"The court is also important to examine the substance of the pilkada and the law enforcement process during the elections," said Khoirunnisa.

From all existing dispute processes, he also asked the parties to respect, obey and implement the Court's decision later in good faith because the Court's decision is a final and binding decision.
