Lukas Enembe Didakwa Receives Bribe And Gratification Of IDR 46.8 Billion

JAKARTA - Papua Governor for the 2013-2018 and 2018-2023 periods Lukas Enembe was charged with accepting bribes worth Rp45,843,485,350 and gratuities of Rp1 billion from a number of partners.

"The defendant Lukas Enembe as the Governor of Papua for the period 2013-2018 and 2018-2023 together with Mikael Kambuaya as the Head of the Papua Public Works Service in 2013-2017 and Gerius One Yoman as the Head of the Papua Public Works and Spatial Planning (PUPR) Office (PUPR) in 2018-2021 received a total prize of Rp45,843,485,350," said KPK public prosecutor (JPU) Wawan Yunarwatno at the Jakarta Corruption Court (Tipikor) reported by ANTARA, Monday, June 19.

The trial for reading the indictment was attended by Lukas Enembe who previously objected on Monday (12/6) because he wanted to attend the trial in person and not via video conference connection.

While listening to the reading of the indictment, Lukas Enembe sat in the defendant's seat accompanied by one of his legal advisers, Petrus Bala Pattyona.

Of the bribes, according to the KPK prosecutor, as many as Rp10,413,929,500 came from Piton Enumbi businessman as Director and owner of PT Meonesia Mulia, PT Lingge-Lingge, PT Astrad Jaya and PT Melonesia Cahaya Timur and as much as Rp35,429,555,850 came from Rijatono Lakka as Director of PT Tabi Anugerah Pharmindo, PT Tabi Bangun Papua as well as CV Walibhu.

"So that Lukas Enembe together with Mikael Kambuaya and Gerius One Yoman, the companies used by Piton Enumbi and Rijatono lakka were won in the process of procuring goods and services within the Papua Provincial Government for the 2013-2022 fiscal year," said prosecutor Wawan.

Piton Enumdi diketahui adalah tim sukses Lukas Enembe dalam pemenangan Gubernur Papua periode 2013-2018. Lukas pun menginstruksikan kepada Mikael Kambuaya untuk memberikan proyek kepada Piton Enumdi.

"The defendant also divided the work project rations based on the status of the Papua Province road where later based on the road segment the budget will be determined and whoever the contractor will get a job with the agreement the defendant will receive the fee for the project obtained by Piton Enumbi," added the prosecutor.

Piton Enumbi during 2013-2022 obtained 10 projects carried out by three companies with a total contract of IDR 198,104,439,725.

Furthermore, in the period January 2017 - July 1, 2020, Piton Enumbi gave a fee, namely through bank transfer to accounts in the names of Lukas Enembe and Rifky Agereno and Agus Parlindungan Tambunan and paying for goods for Lukas Enembe through a credit card belonging to Piton Enumbi so that the total fee reached Rp10,413,929,500.

Meanwhile, Rijatono Lakka also became a successful team to win Lukas Enembe in the 2018 regional elections. Previously, Rijatono Lakka had renovated the private house of Lukas Enembe in 2017.

Rijatono Lakka then asked Lukas Enembe for the project as compensation for the victory in the election. Lukas Enembe agreed by asking Tijatono to provide a fee on the project obtained.

"The defendant then ordered Gerius One Yoman as the Head of PUPR Papua to seek Rijatono Lakka as a provider of goods/services in projects sourced from the Papua Regional Budget," added the prosecutor.

Gerius One then ordered the Head of Water Resources Management of the Papua PUPR Service, Nataniel Kandai, to assist Rijatono Lakka by providing a reference framework (SEZ) and details of unit prices at the estimated price (HPS) of the PUPUR official project which will be auctioned so that Rijatono Laks using the data to prepare the bidding documents.

The Papua Province Procurement Service Bureau, which knows that Rijatono Lakka is a deposit from Lukas Enembe also won the Rijatono Lakka company, namely CV Walibhu and several companies whose flags were borrowed to work on the project, namely PT Aiwondeni Permai, PT Papua Sinar Anugerah, PT Cahaya Rante Tondo, CV Skyander and PT Vertical Tiara Manunggal.

Rijatono Lakka throughout 2017-2021 also received 12 projects with a total value of IDR 110,469,553,936.

Rijatono Lakka then gave a fee of IDR 1 billion on May 11, 2020 through bank transfer to Lukas Enembe's account. In addition, Rijatono Lakka in the 2019-2021 period carried out physical renovations belonging to Lukas Enembe through CV Walibhu with a total value of IDR 34,429,555,850.

For his actions, Lukas Enembe was charged with accepting bribes, namely Article 12 letter a or Article 11 of Law No. 31 of 1999 as amended by Law No. 20 of 2001 concerning the Eradication of Criminal Acts of Corruption in conjunction with Article 55 paragraph 1 of the Criminal Code in conjunction with Article 65 paragraph 1 of the Criminal Code.

In addition to accepting bribes, Lukas Enembe was also charged with receiving gratuities in the form of money amounting to Rp1 billion related to his position and contrary to his obligations as Governor of Papua for the 2013-2018 period.

"That as Governor of Papua for the 2013-2018 period on April 12, 2013 at Bank BCA KCU Jayapura the defendant had received Rp1 billion from Budy Sultan as Director of PT Indo Papua through Imelda Sun which was sent to the defendant's account," said the prosecutor.

Regarding the acceptance of the gratuity, Lukas did not report to the KPK within a grace period of 30 days as stipulated by law even though the acceptance was without a legal basis.

For his actions, Lukas was charged with Article 12 B of Law No. 31 of 1999 as amended by Law No. 20 of 2001 concerning the Eradication of Criminal Acts of Corruption.

On this charge, Lukas Enembe immediately filed a note of objection (exception).

"The objection will be read out directly because Mr. Lukas has had a stroke and will be read out alternately by me, Mr. Kaligis and Purwaning. It's just that our petition was unable to consult him, that's why we have the right to inform him to His Majesty after the trial can be met, not hindered," said Lukas' legal adviser, Petrus Bala Pattyona.
