JAKARTA - The Civil Society Coalition, Guarding the Clean Election, submitted a request for a judicial review of the General Election Commission (PKPU) Regulation Number 10 and 11 of 2023, which is related to the requirements for nominating members of the former corruption convict, to the Supreme Court (MA).
Indonesia Corruption Watch (ICW) researcher Kurnia Ramadhana, as the representative of the coalition, said that his party considered the PKPU 10 and 11 of 2023 to be against the decision of the Constitutional Court (MK).
"As for the two PKPUs, we value that they are contrary to the decision of the Constitutional Court, especially with regard to the exceptions for former convicts, especially criminal acts of corruption, who will run as members of the legislature in the 2024 General Election," Kurnia said when met at the MA Building, Jakarta, Monday, June 12, was confiscated by Antara.
He explained that the Constitutional Court Decision Number 87/PUU-XX/2022 and Number 12/PUU-XXI/2023 required former corruption convicts to pass a five-year gap in order to run for legislative candidates.
However, said Kurnia, the KPU in the two PKPUs provided exclusion conditions for former corruption convicts who obtained permanent legal force for additional criminal revocation of political rights.
"By the KPU, there is actually an exception requirement by adding an additional penalty for revocation of political rights. So, if the convict is sentenced to an additional sentence of revocation of one year's political rights, then in the second year they can immediately run as members of the legislature," explained Kurnia.
The articles submitted for objection by the civil society coalition are Article 11 paragraph (6) PKPU No. 10 of 2023 concerning the Nomination of DPR Members, Provincial DPRD and Regency/City DPRD, as well as Article 18 paragraph (2) PKPU No. 11 of 2023 concerning the Nomination of DPD Members.
"For us, the PKPU formed by the KPU is an effort to degrade the value of integrity in the upcoming election," said Kurnia.
In the submission of a judicial review to the Supreme Court today, the Civil Society Coalition to Guard the Clean Election consisted of ICW, Association for Elections and Democracy (Perludem), Commissioner of the 2015-2019 Corruption Eradication Commission (KPK) Saut Situmorang, and Commissioner of the Corruption Eradication Commission 2011-2015 Abraham Samad.
Furthermore, Saut Situmorang added, his party hopes that the Supreme Court can decide on this polemic immediately so that there is certainty for the implementation of the 2024 General Election.
"So that there is certainty about the actual implementation of our democratic party which was linked to the existence of several problematic people in the past so that then we can create smart politics and integrity that we have known and that is what we promote at the KPK," said Saut.
