Possible Case Raffi Ahmad Crowd Released From Criminal

JAKARTA - Head of Public Relations of Polda Metro Jaya Kombes Yusri Yunus said, based on a temporary investigation, the birthday party that was attended by Raffi Ahmad after being vaccinated against COVID-19 was not proven to have violated the health protocol (prokes).

"The element of the suspicion in Article 93 does not exist because there are only 18 people there, they enter the prokes, we have checked everything," Yusri told reporters, Tuesday, January 18.

The results of the temporary investigation, said Yusri, were that the event was held privately and only invited those closest to Ricardo Gelael who are the owner of the house. In addition, the number of guests who attended was only 18 people.

Then, this event also implements a fairly strict prokes. For example, every guest who is present must first undergo an antigen swab before entering the house that is used as a party venue.

"The three pillars of the task force have gone directly to the residence of RG's brother (Ricardo Gelael) and have seen it firsthand. That was a privacy activity carried out by 18 people who were approached," he said.

"Entering the prokes, we have checked everything, there is an antigen swab, only 18 people in it, only the closest people to the event," continued Yusri.

However, the house owner or the initiator of the event never asked the authorities for permission.

For that, in the near future the police will conduct a case title. The goal is to ensure there is a violation behind the birthday event.

"Yes, we will hold it later, but if we look at it from this there is no (alleged criminal violation)," said Yusri.

So far, said Yusri, a number of witnesses who have been questioned are people who participated in the event. They include the owner of the house to the security of the house.

"We have already clarified. The owner of the house has already done so, everything has been done. We will hold it later," he said.

Meanwhile, a criminal law expert from Al Azhar University Suparji Ahmad said that with a statement from the police regarding this matter, it is likely that Raffi will not be caught in the law.

"Yes, then (about the police statement) then the case will stop," said Suparji.

In addition, in the crowd that involved Raffi Ahmad, there were several things that did not fulfill Article 93 of the Territorial Law. One of them is related to the deterrent element.

The unfulfilled element, said Suparji, was due to multiple interpretations in the context of obstructions. However, regardless of whether there is a violation behind the Raffi Ahmad problem, it will be answered in the case title.

"Wait for the results of the case title, that will determine later," he said.

Apart from that, Suparji noted that Raffi Ahmad, as a public figure, should have been more careful. Because, all of his actions will have a big impact on society.

"What needs to be anticipated is that Raffi is positioned as an influencer who is expected to influence the public, especially millennials. But it is feared that what is being done now will be followed by millennials," he said.

"There is already a receipt from the Chief of Police, it is asking Raffi Ahmad and his friends to be arrested," he said.

Raffi Ahmad became the center of attention because he was involved in a crowd at a birthday party at one of the houses located at Jalan Prapanca Dalam No.3, Pela Mampang, Mampang Prapatan, South Jakarta. In fact, he had just been injected with the COVID-19 vaccine.
