Prior to the Verdict Trial, Bharada E's Camp Alluded to Justice Collaborator and Position Orders

JAKARTA - The defendant Richard Eliezer alias Bharada E mentioned that two things had to be considered by the panel of judges in making a decision or verdict. The first is the status of a justice collaborator (JC) and an order of office.

"Of course, there are two points that we want to convey. The first is his status as a Justice Collaborator," said Bharada E's legal adviser, Ronny Talapessy, to journalists, Wednesday, February 15.

Referring to Article 10A of Law Number 31 of 2014 Protection of Witnesses and Victims, a person with JC status should be subject to the lowest sanction.

Therefore in this case, Bharada E must receive the lightest sanction than the other defendants in the case of the premeditated murder of Yosua alias Brigadier J.

"Imposition of the lightest sentence or probation. We will see that in this case too, the Judge can decide referring to the Justice Collaborator," he said.

The second point, the panel of judges can also consider Article 51 paragraph 1 regarding the order of office. This is because all of Bharada E's actions shot Brigadier J on orders from Ferdy Sambo.

With these two things, Ronny hopes that the panel of judges can decide on fair sanctions. In fact, it is possible that Bharada E will be acquitted.

"In the facts of the trial, it appears that Richard Eliezer's position, that we hope, that in this case, in the second point that I mentioned earlier, the Judge can release Richard Eliezer or acquit Richard Eliezer. If you look at our petitum and the facts of the trial," said Ronny.

In this series of cases, Bharada E was named as the executor of the shooting which occurred at the official residence of the Police Complex, Duren Tiga, on 8 July. He shot Brigadier J three to four times.

Bharada E admitted that he had to do the shooting. Because at that time he was under pressure from Ferdy Sambo.

At the previous trial, the public prosecutor (JPU) stated that Bharada E was proven to have violated Article 340 of the Criminal Code in conjunction with Article 55 Paragraph 1 to (1) of the Criminal Code. So, he was sentenced to 12 years in prison.
