JAKARTA - The Indonesian government is confident that it can bring back several assets resulting from corruption, Robert Tantular, in Singapore in the case of the Century Bank which is currently rolling in the UK Court.

The Director General of General Legal Administration (Dirjen AHU) of the Ministry of Law and Human Rights Cahyo R Muzhar stated that the Government is optimistic that the decision on the Century Bank case which is currently rolling in the UK court will benefit Indonesia. "Observing the opinion of the panel of judges, we are optimistic that the final decision will benefit Indonesia so that we can bring home assets and hand them over to the state," said Cahyo as quoted by ANTARA, Monday, February 13. Cahyo assessed, in line with the view presented by the panel of judges at the trial of The Judicial Committee of The Privy Council (JCPC) in the UK on February 8 and 9, 2023. One of the things that was conveyed by the panel of judges in the trial on February 8, 2023 was that they viewed the confiscation that the Indonesian government proposed against assets belonging to convict Robert Tantular in that case allowed it to be carried out and not violate international law provisions. "This gives hope for Indonesia," said Cahyo. Previously, Robert Tantular's legal team of attorneys is of the view that based on British law and a number of international conventions, the Jersey government is not authorized to confiscate property that is outside of British jurisdiction. The property in question is an apartment in Singapore and is owned by the company Robert Tantular registered in Jersey, UK., at the trial of February 9, 2023, the Attorney General of Jersey as representatives of the Indonesian government in the trial had the opportunity to submit arguments by emphasizing that confiscation of assets belonging to the Tantular family located in Singapore may be carried out. This is in accordance with the provisions in the Proceeds of Crime (Enforcement of Confiscation Orders).

Until now, the Ministry of Law and Human Rights (Kemenkumham) continues to be committed to overseeing the settlement of the Century Bank case, one of which is by attending the trial in England. The final decision of the case is expected to be issued in the next 2 months. In addition to the trial in England, the Ministry of Law and Human Rights is also overseeing the proceedings of the Century Bank which is currently underway in the jurisdiction of Hong Kong and is awaiting the issuance of a trial schedule.
