Muhamad-Sara Sues South Tangerang Regional Election Results, Offends Airin And TSM, Asks Regional Election To Be Repeated

JAKARTA - The candidate pair Muhamad-Rahayu Saraswati Djojohadikusumo has filed a lawsuit against the results of the South Tangerang City Regional Election (Tangsel). Previously, KPU named Benyamin Davnie-Pilar Saga Ichsan as the winner with superior votes.

Quoted from the website of the Constitutional Court, Sunday, December 27, the applicant submitted a request to cancel the decision of the South Tangerang City KPU Number: 470 / HK.03.1-Kpt / 3674 / KPU-Kot / XII / 2020 concerning the Determination of the Recapitulation of Vote Count Results for the Election of Mayor and Deputy Mayor South Tangerang City on December 17th.

For the petitioner, namely Muhamad-Sara through their attorney, the petition is very grounded by excluding the threshold considering that the problem criteria proposed by the petitioner in the Tangsel City Regional Election dispute application are that there has been a structured, systematic, massive (TSM) violation.

The petition describes the determination of the vote count results by the respondent (KPU), the votes acquired by each pair of candidates as follows:

1. Muhamad-Rahayu Saraswati Djojohadikusumo: 205,309

2. Siti Nurazizah-Ruhamaben: 134,682

3. Benyamin Davnie-Pilar Saga Ichsan: 235,734

"The process of organizing the Pilkada of Tangsel City was obtained through a series of manipulative actions, full of violations and full of fraud that were structured, systematic, and massive.

The petitioner for the dispute over the South Tangerang City Regional Election is that there has been a structured, systematic and massive violation, "said the dispute over the results of the Regional Head Election which was registered with the Constitutional Court on December 21.

The applicant described the TSM violation, namely that the distribution of Baznas funds was called the application to be used as a tool for winning candidate pair number 3 (incumbent).

"Whereas the candidate pair number 3 Benyamin Davnie and Pilar Saga Ichsan are part of the current government, whose mayors Airin Rachmi Diany and Benyamin Davnie serve as deputy mayor of Tangsel who are running as candidates for mayor of Koga. Furthermore, Ichsan Saga Pillar is the nephew of Airin Rachmi Diany so that he has the same political interests to win the candidate pair, "said the petitioner.

There was also the involvement of Airin Rachmi Diany as a campaign team with direct compensation for orphans whose source of funds was called the applicant from the National Zakat Agency distributed to 54 urban villages, 7 sub-districts throughout South Tangerang City.

"Where the distribution of these funds is proven to be used to invite the public to win the candidate pair number 3," continued the applicant.

There are also allegations that the applicant referred to ASN's direction in an effort to win candidate pair number 3. In addition, the Pilkada organizers were called the applicant not neutral.

"The Respondent as the organizer did not maintain neutrality and independence in the implementation of the South Tangerang City Regional Election in which 280 KPPS members were directly involved as the success team of candidate pair number 3 in the effort to win the South Tangerang City Regional Election," continued the petitioner.

Furthermore, the allegations of money politics were carried out by supporters of Benyamin Davnie-Pilar Saga Ichsan.

"There has been money politics committed by supporters of candidate pair number 3 on behalf of Muhammad Willy Prakasa bin Abdul Somad by distributing money to voters as it has also been decided in the criminal court that it has been proven guilty based on the decision of the Tangerang District Court dated November 30, 2020," said the petitioner.

In the petitum, the applicant Muhamad-Sara through their attorney asked the Constitutional Court to declare the disqualification of candidate number 3 Benyamin Davnie-Pilar Saga Ichsan in the South Tangerang Regional Election.

"Ordered the respondent to carry out a re-voting in all TPS in Tangsel City, which was attended by all candidate pairs," said Muhamad-Sara's petitum.
