Brigadier J's Session, Father Magnis As A Moral Expert Calls There Are 2LOWing Elements Of Bharada E

JAKARTA - Professor of moral philosophy who was presented as an expert, Prof. Father Frans Magnis Suseno, said there were two elements that could relieve Richard Elizer alias Bharada E in the alleged murder case against Brigadier J. Starting from rank to time limitation.

Father mMagnis explained that the first element that could be mitigated was the rank in the National Police. Bharada E is the lowest police officer in the police agency.

During the shooting incident, he was ordered by Ferdy Sambo who was a two-star general. So, it was considered that he was forced to carry out the order.

"The culture is the strongest element," said Father Magnis during a trial at the South Jakarta District Court (PN Jaksel), Monday, December 26.

Then, there is an element of limited time to think. He could not make that tough decision quickly.

"Freedom to still consider how many seconds available may not exist," he said.

On that basis, Bharada E is allowed to experience a moral dilemma because on the one hand he must carry out orders in accordance with the culture of orders.

While the other side of knowing the shooting of a person without a basis is an act that is not justified.

"He had to react immediately. Those are two ethically mitigating factors," said Father Magnis Suseno, who is also a cultural observer.

Bharada E is known to have shot his senjor, Brigadier J, with a GUARD-17 firearm.

The shooting was called on the orders of the former Head of the Propam Division, Ferdy Sambo, which took place at the official residence of the Police Complex, Duren Tiga, South Jakarta, on July 8.

However, before shooting, he had time to pray first. The reason is that Bharada E doubts the orders given to him.

Meanwhile, in this case there are also four other defendants. They are Ferdy Sambo, Putri Candrawathi, Bripka Ricky Rizal, and Strong Ma'ruf.

They were all charged with Article 340 of the Criminal Code, subsidiary to Article 338 of the Criminal Code in conjunction with Article 55 paragraph 1 to (1) of the Criminal Code with a maximum threat of death penalty, life imprisonment or a maximum of 20 years.
