Acting Governor Heru Copot Marullah From The Regional Secretary, Taufik Gerindra: Don't Under The Rules!

JAKARTA - Member of the DKI DPRD from the Gerindra faction, Mohamad Taufik, views the decision of the Acting Governor of DKI Jakarta Heru Budi Hartono to remove Marullah Matali from the position of Regional Secretary (Sekda) of DKI Jakarta to violate the rules.

In this case, Heru removed and shifted Marullah from the position of DKI Regional Secretary to Deputy Governor for Culture and Tourism in DKI Jakarta.

"This country has legal rules. All policies must be based on applicable regulations and laws," said Taufik in his statement, Wednesday, December 7.

Taufik views Heru's decision to shift the position of DKI Regional Secretary to violate Law Number 5 of 2014 concerning State Civil Apparatus (ASN).

Article 116 Paragraph (1) of the ASN Law states that personnel guidance officials are prohibited from replacing high-ranking officials for two years starting from the inauguration of high-ranking officials, unless the high-ranking officials violate the provisions of the legislation and no longer meet the stipulated position requirements.

"Now Marullah has violated the rule of law or not? Right, no. Don't just go around with it," said Taufik.

In addition, Taufik continued, Heru also violated the rules in the Domestic Regulation Number 91 of 2019 concerning the Appointment of the Acting Regional Secretary.

Article 2 of Permendagri 91/2019 states that the appointment of the acting regional secretary is carried out in terms of: a. period of 3 (three) months the absence of a regional secretary is exceeded; and b. the definitive regional secretary has not been determined.

Therefore, Taufik suspects that Marullah's removal from the position of Secretary of DKI was carried out only based on Heru's political considerations or dislikes. Moreover, the DKI Regional Secretary is also the chairman of the Regional Government Budget Team (TAPD) which plays a strategic role in drafting the APBD.

"Dear Governor of DKI, follow the ASN Law and Regulation of the Minister of Home Affairs Number 91 of 2019. Do not get used to hitting the rules!" he said.

It is known that Heru shifted Marullah's position from the position of Secretary of DKI to Deputy Governor in the inauguration on Friday, December 2.

To fill the temporary vacuum, Heru inaugurated Uus Kuswanto as Acting Regional Secretary of DKI. The plan is that the definitive appointment of the DKI Regional Secretary is expected to be elected by the end of December 2022 or early January 2023.
