BANJARMASIN - The public prosecutor (JPU) demanded the defendant, an employee of the Barabai Branch Pegadaian (UPC) Rantau, South Kalimantan, Risti Annisa Fitria, to compensate the state's financial losses of Rp. 2.25 billion. The amount of rupiah that the defendant had to replace was due to corruption. "The replacement of this state loss is an additional crime, in addition to being sentenced to eight years in prison and a fine of Rp. 400 million, subsidiary to imprisonment for three months," said Public Prosecutor Dwi Kurnianto and Thesa Tamara Sanyoto during a trial reading of the charges at the Banjarmasin Corruption Court, Antara, Wednesday, October 12. The Public Prosecutor stated that if the replacement money was not paid no later than one month after the decision had permanent legal force, then his property could be confiscated by the Prosecutor and auctioned off to cover the loss. However, if the defendant does not have sufficient property to be confiscated and auctioned off to cover the replacement money, it will be replaced with imprisonment for four years. The Public Prosecutor believes that the defendant has committed a criminal act of corruption as charged in the primary indictment. The indictment in question is Article 2 paragraph (1) Jo. Article 18 of the Republic of Indonesia Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption as amended by Law of the Republic of Indonesia Number 20 of 2001 concerning Amendments to Law of the Republic of Indonesia Number 31 of 1999 concerning Eradication of Criminal Acts of Corruption Jo. Article 64 paragraph (1) of the Criminal Code. Hearing the demands, the defendant who was given the opportunity was given the Chief Justice Heru Kuntjoro to convey his defense hopes that he will be given a sentence as often as possible. "I regret and ask for leniency because I take care of my sick mother every day," he said, who attended a virtual trial from the Class II B Rutan Rantau. The trial will continue on October 26, 2022, with the agenda of reading the verdict by the panel of judges. It is known that the defendant's actions in misappropriating credit repayment funds on 127 credit accounts quickly secured (KCA) at UPC Rantau in the range of 2019 to 2020 have caused state losses of Rp2.8 billion. The mode is not to deposit KCA repayment funds from customers to Pegadaian cash and keep KCA's status active even though the debtor's collateral has been paid off.
