11 TNI Soldiers Who Knocked Down Jusni To Death Sentenced To Guilt

JAKARTA - As many as 11 TNI soldiers were convicted by the Jakarta Military Court Judges for being involved in beatings up which resulted in a resident named Jusni (24) dead.

"To declare that the defendants have been legally and convincingly guilty of committing a criminal act by jointly committing torture that resulted in death," said chief judge Lt. Col. Chk Sahrul while reading the verdict at the Jakarta Military Court, Cakung, East Jakarta, Wednesday, November 25.

The 11 TNI soldiers who were found guilty of beating the victim to death in Tanjung Priok, North Jakarta, in February 2020, namely Letda Cba Edwin Sanjaya, were sentenced to 11 months in prison. Meanwhile, Lt. Cba Oky Abriansyah was sentenced to prison for a year and 2 months following an additional sentence of being fired from the Indonesian Army.

Serka Endika Sanjaya was sentenced to 11 months in prison, Sertu Junaedi was sentenced to 10 months in prison, Serda Erwin Ilhamsyah was sentenced to 9 months and 20 days in prison, Serda Galih Pangestu was sentenced to 9 months and 20 days in prison and Serda Hatta Rais was sentenced to 9 months in prison 20 days.

Serda Mikhael Julianto Purba was sentenced to imprisonment for a year following an additional sentence of dismissal from the Army, Serda Prayogi Dwi Firman Hanggalih was sentenced to imprisonment for 10 months, Praka Yuska Agus Prabakti was sentenced to imprisonment for 10 months and Praka Albert Panghiutan Ritonga was sentenced to 11 months in prison .

All defendants were found guilty of violating Article 351 paragraph 3 of the Criminal Code in conjunction with Article 55 paragraph 1-1 of the Criminal Code in conjunction with Article 26 of the Indonesian Criminal Code in conjunction with Article 190 paragraph 1 in conjunction with paragraph 3 in conjunction with paragraph 4 of Law Number 31 of 1997 concerning Military Justice.

The judge also ordered the defendants to remain detained.

The sentences against the 11 TNI soldiers were lower than the demands of the military prosecutors. The prosecutor demanded that the 11 soldiers be sentenced to 1 to 2 years in prison each.

The victim of this case is Jusni, a 24-year-old man from Kolowa Village, Buton Regency, Southeast Sulawesi. When the attacking took place, Jusni was only three months old in Jakarta and was looking for work on a cruise with his friends.

The attack in Tanjung Priok, North Jakarta, on February 9, 2020, resulted in the victim being injured as a result of a blunt force collision during the perpetrator's abuse.

The case caught the attention of the Commission for Missing Persons and Victims of Violence (Kontras), which released a video of beating Jusni via a Twitter account on Monday, November 16.
