The Judge Thinks The Request For Judicial Review On The Revision Of The Constitutional Court Law Is Full Of Prejudice

JAKARTA - Constitutional Justice Manahan MP Sitompul assessed that the petition for reviewing the revision of the Constitutional Court (MK) Law submitted by a number of researchers and lecturers who are members of the Save the Constitutional Court Coalition is full of opinion and prejudice.

"I see from the descriptions submitted in the petition, you are giving prejudice opinions, this is not necessary," said Manahan Sitompul in an online first session at the Constitutional Court (MK) building quoted by Antara, Thursday, November 19.

According to him, the petitioners' petition was quite thick with reports containing comments on Law Number 7 of 2020 concerning the Third Amendment to Law Number 24 of 2003 concerning the Constitutional Court.

Instead of including an opinion in the petition, he advised the applicant to include a theory related to the formal examination and its development.

Manahan Sitompul gave an example that the argument for the formation of the law was carried out hastily and in a closed manner, which determines whether it is true or not, is evidence, witnesses, and experts.

Previously, the petitioners, namely Giri Taufik, Violla Reininda, Muhammad Ihsan Maulana, Rahmah Mutiara, Korneles Materay, Beni Kurnia Illahi, and Putra Perdana Ahmad Saifullohi submitted formal and material reviews of the revision of the Constitutional Court Law.

For the formal review, according to the petitioners, the revision of the Constitutional Court Law was formed behind closed doors and was rushed in the process which lasted less than a month.

Furthermore, the petitioners questioned the academic text of the Constitutional Court Bill which was considered bad because it did not provide a comprehensive analysis of the amendments to the provisions of the Constitutional Court Bill.

For the judicial review, the articles in question are Article 15 Paragraph (2) letters d and h, Article 20 paragraph (1) and (2), Article 23 Paragraph (1) Letter c, Article 59 Paragraph (2), Article 87 letter a and b Law Number 7 of 2020.
