Mahfud: The Request For The Perppu For Job Creation Was Heard, But Only Recorded As A Proposal

JAKARTA - The Coordinating Minister for Political, Legal and Security Affairs (Menko Polhukam) Mahfud MD said that his party was paying attention to the request that came into the government to issue a Perppu related to Law Number 11 of 2020 concerning Job Creation.

However, he stressed that the government would not issue a Perppu but only recorded it as a proposal.

"In the meantime, we have recorded the Perppu as a proposal," Mahfud said in an online discussion held by Gadjah Mada University (UGM), Tuesday, November 17.

The former Chief Justice of the Constitutional Court (MK) said that if the Perppu was later issued it could cause polemics in the community. So, the government will not issue a Perppu which is the demand in a number of demonstrations against this law.

"If we want to change the Perppu, there will be a lot later why the Perppu only changes that," he said.

"But if it only regulates the Perppu on criminal regulation, for example, people will be noisy again getting into other substances. So that later this will not be resolved," he added.

Although the government does not plan to issue a perppu, Mahfud emphasized that there are still a number of ways that the government has opened up so that the public can provide input. One of them is through a judicial review at the Constitutional Court.

"The channels provided by the government are judicial review, legislative review, and pouring derivative regulations in other laws," he explained.

Previously, President Joko Widodo (Jokowi) had responded to demands for student and labor demonstrations that urged him to issue the Job Creation Law Substitute Regulation (Perppu) or Law No. obeyed.

Moreover, in the discussion, the Omnibus Law Bill on Work Creation which has now been promulgated was discussed for months in accordance with the constitutional process and he admitted that it was quite difficult to submit a draft law. So it is impossible for him to issue a Perppu.

"Wong is the one who proposed us, how difficult it will be when we agree to issue the Perppu. After all, we are the ones who propose to issue a Perppu," said Jokowi in his exclusive interview with Rosiana Silalahi which was broadcast on Kompas TV, Monday, November 16.

Jokowi said that before it was passed, the Job Creation Bill had been discussed for eight months in the DPR. In addition, in the process, all party factions in the DPR which he considered represented the wishes of the public had provided notes and input on the legislation. Therefore, Jokowi felt that he did not need to issue a Perppu.

If there are things that need to be improved, Jokowi assesses this can be done through a derivative regulation which is currently being discussed by the relevant ministries and institutions.

"The most important thing is how this law is corrected, if there are things that have not been accommodated then accommodated in the PP and Perpres. I think so," he said.
