JAKARTA - The General Election Commission (KPU) has not included the issue of new autonomous regions in the Draft KPU Regulation (PKPU) for the Stages of Registration, Verification, and Determination of Political Parties which will be brought to a hearing at the DPR on Thursday, July 7.
"In the PKPU draft we did not include a clause related to the new autonomous regions (DOB) because the KPU is the executor of the law," said KPU commissioner Idham Holik, quoted by Antara, July 5.
This, he continued, was because in the Election Law, the areas listed were still in the number of 34 provinces, while the 3 new autonomous regions or 3 new provinces in Papua had not been included in Law Number 7/2017.
"In attachments 1, 2, 3, and 4, 34 provinces are listed, unless the law has been revised, in particular attachments 1, 2, 3, and 4. We are still using Law Number 7 of 2017," he said.
Idham said a revision of the UU or perppu for the Election Law was needed to regulate the implementation of elections in the new autonomous regions of the provinces of South Papua, Central Papua, and Papua Mountains.
The draft law or perppu will later become the basis for the rules for structuring electoral districts in the 2024 general election and the rules for implementing the elections for the new provincial DPRD.
"One of the principles of holding elections is the principle of legal certainty," he said.
According to the KPU, if new autonomous regions can be included in the 2024 General Election, then there needs to be a revision of the Law or Perppu that had been issued before the nomination stage for the DPD RI.
"It can actually be seen in PKPU Number 3 of 2022, when it comes to holding elections, of course there is a nomination period. There are 11 stages and one of them is the nomination stage. The nomination stages for the election of DPD RI members range from 6 December 2022-25 November 2023," he said .
The KPU will wait for the invitation from the government and DPR RI if it wants to make a government regulation in lieu of a law or revise the law for the Election Law.
"We will wait for a letter from the government or an invitation from the DPR and the government regarding this matter," he said.
