One Year Of Attorney General's Performance, 101 Cases Are Terminated

JAKARTA - The Attorney General's Office explained the performance for one year under the leadership of ST Burhanuddin. Among them, stopping 101 minor criminal cases in restorative justice or restorative justice.

Head of the AGO's Legal Information Center, Hari Setiyono, said that the restorative termination of the prosecution was signed by Attorney General ST Burhanuddin on July 21. This termination is in accordance with the Republic of Indonesia Prosecutor's Regulation Number 15 of 2020 concerning Cessation of Prosecutions based on Restorative Justice.

"The prosecutors have carried out 101 cases of termination of prosecution based on restorative justice," Hari told reporters, Monday, October 26.

Hari detailed, the 101 cases included 97 cases involving individual victims and 4 cases involving victims from companies or state institutions.

Settlement of cases in this way aims to adjust the paradigm shift of society from retributive justice (retaliation) to restorative justice.

"Of course only certain criminal acts can be carried out by terminating prosecution based on restorative justice," he said.

Some of the conditions that must be fulfilled in restorative justice settlement of cases include the suspect for the first time committing a criminal act, the threat of a fine or imprisonment of not more than 5 years, and evidence or loss in the case of not more than IDR 2.5 million.

In addition, the implementation must also involve the perpetrator, the victim, the perpetrator's or victim's family, and other related parties.

"Settlement of minor cases (trivial cases) and cases that may be resolved peacefully," he said.

Using this method of settlement can help reduce congestion and cases in court. So that the court can concentrate on solving major cases that harm the community, save time and budget, so that the law becomes efficient.
