JAKARTA - The man from India was pronounced dead by a doctor at a private hospital on Monday and his family will hold a funeral the following day. However, the morgue staff found him shaking and realized he was still alive.

According to the Daily Star , Saturday, October 17, Balasubramanyam died days after being rescued from a mortuary refrigerator in Salem, in the southern Indian state of Tamil Nadu.

Police said they had registered a case against the family for "acting recklessly or negligently endangering human lives".

Salem police chief Senthil Kumar said the family could not produce a medical certificate for Balasubramanyam's death.

Dr Balajinathan, head of the government hospital in Salem, said the patient was treated in a drowsy condition and died from lung related problems.

He said it was unclear how many hours Balasubramanyam was in the freezer and whether his death was a result of the cold.

The family claims that Balasubramanyam is also suffering from neurological problems. Balasubramanyam is survived by his wife, two daughters and a brother.

When he was first pronounced dead on Monday, Balasubramanyam's family took his body home and called local officials to send a refrigerator box. They then informed the relatives that they would be holding a funeral the following day.

The funeral company said they were told by Balasubramanyam's brother that he had "a letter signed by a doctor about his death".

It is unclear how Balasubramanyam survived the freezing temperatures in the box for nearly 24 hours. The Daily Star also did not specify whether the private hospital, where he was originally pronounced dead, was investigated for the incident.
