Will Submit PK On Cassation Decision That Corrects Edhy Prabowo's Sentence, KPK Study Prosecutor's Law

JAKARTA - The Corruption Eradication Commission (KPK) will do several things before submitting a judicial review (PK) on the cassation decision of former Maritime Affairs and Fisheries Minister Edhy Prabowo. One of them is by studying the Prosecutor's Law.

"Is it possible or not with the new Prosecutor's Law, is it possible to apply for a PK by the KPK or not," said Acting Spokesperson for the KPK for Enforcement, Ali Fikri, quoted from the Indonesian KPK YouTube, Saturday, April 2.

In addition, Ali said his party would study the full decision from the cassation which cut Edhy Prabowo's sentence to four years. However, he said, this step was hampered because the KPK had not yet received a complete copy from the Supreme Court.

Instead of a complete verdict, the Corruption Eradication Commission (KPK) has just received an excerpt of the verdict that will be carried out to execute Edhy Prabowo to a correctional facility.

"So far we have not received a copy in its entirety. However, for the excerpt of the verdict, the information from the prosecutor's team has received and is still in the process of being prepared for execution," he stressed.

"Later, we will inform you of the execution process, both the prison body and the execution of its assets," Ali added.

As previously reported, the Supreme Court reduced Edhy Prabowo's sentence from 9 years to 5 years in prison. In its consideration, the cassation panel said the former minister had done a good job.

This decision was approved by the assembly consisting of Sofyan Sitompul, Gazalba Saleh, and Sinintha Yuliansih Sibarani on 7 March.

There was also the intention of working well during his tenure, because Edhy revoked the Regulation of the Minister of Maritime Affairs and Fisheries Number 56/PERMEN-KP/2016 dated December 23, 2016 and replaced it with the Regulation of the Minister of Maritime Affairs and Fisheries Number 12/PERMEN-KP/2020 which aims to utilize seeds lobster.

"That is, they want to empower fishermen and also to cultivate them because lobster in Indonesia is very large. Furthermore, in the Minister of Maritime Affairs and Fisheries Regulation Number 12/PERMEN-KP/2020, exporters are required to obtain lobster clear seeds (BBL) from small fishermen who catch BBL," taken from the consideration of the appeal.

"So it is clear that the defendant's actions are for the welfare of the community, especially small fishermen," added the consideration of the cassation panel.
