Depok District Court Holds Trial On Land Case In Beji Worth IDR 54.5 Billion

DEPOK - The District Court (PN) of Depok, West Java, held a trial in the case of a 3,053-square-meter land mafia in Kemiri Muka, Beji on Thursday, March 31. In this case, the value of the lawsuit is Rp. 54.5 billion.

The trial of the lawsuit was led by Panel of Judges Ahmad Adib and clerk Brian Oktavia, attended by the plaintiff and some of the defendants.

The plaintiff's attorney was represented by Farida Felix, SH, MH. Meanwhile, the defendant was attended by his attorney, Yayat Supriatna, SH.

The lawsuit was filed because the land covering an area of 3,053 square meters in Kemiri Muka, Beji, has not been paid in full, but the Sale and Purchase Deeds and certificates have been issued.

"The problem is that the land has not been paid off, how come there is a Deed of Sale and Purchase and the name of the certificate is reversed. That's why a notary and the Depok City Land Office are also defendants," said Farida Felix in a statement, Thursday, March 31, as reported by Antara.

The land is owned by a number of his clients. In the transaction involving buyers PT MM, PT GOBM, and an individual with the initials MU. The three of them became defendants I, II, and III respectively.

The lawsuit also dragged the notaries of RS, DP and NYJ. They are defendants IV, V, and VI, respectively. Meanwhile, the Depok City Land Office became Defendant VII.

Farida Felix revealed that the buyer only paid Rp. 15 billion in 2016. While the remaining Rp. 22.7 billion has not been paid until now.

Farida Felix revealed that the complainants had paid with two Bilyet Giro worth Rp9 billion and Rp11.4 billion. However, in reality the Bilyet Giro cannot be disbursed.

"Then the Deed of Sale and Purchase and the transfer of the name of the Certificate must be declared invalid and null and void," said Farida Felix.

Regarding the amount of material loss, the lawyer for the reporting party stated that the amount was Rp. 54.5 billion.

This value is from the amount of money that has not been paid by the defendant in the amount of Rp. 22.7 billion and a fine of Rp. 31.8 billion. The fine is 2 percent per month of the principal that has not been paid for 70 months from May 2016-March 2022.

Meanwhile, Yayat Supriatna as the defendant's attorney stated that he would still investigate the lawsuit against his client. "We are still investigating further, we'll see you later," replied Supriatna.

The Depok District Court will continue the trial next week.
