JAKARTA - The Minister of Manpower, Ida Fauziyah, said the Minister of Manpower Regulation (Permenaker) No. 2 of 2022 concerning Procedures and Requirements for Payment of Old Age Security Benefits (JHT) was revised to make it easier for workers to disburse JHT funds.

"We are currently revising Permenaker No. 2 of 2022. God willing, it will be completed soon", Ida said as quoted in a ministry press release received in Jakarta, reported by Antara, Wednesday, March 2.

According to her, the government absorbs the aspirations of the trade unions/labor unions and communicates intensely with the relevant ministries/institutions regarding the revision of regulations regarding the payment of JHT funds.

Ida said that until now the Minister of Manpower Regulation No. 2 of 2022 has not been effective, therefore the payment of JHT funds is still carried out referring to the Minister of Manpower Regulation No. 19 of 2015.

"I need to reiterate that the old Manpower Regulation is currently still in effect and is still the basis for fellow workers/laborers to claim JHT. No exception for those who have been laid off or resign can still claim JHT before retirement age", she said.

She also explained that the government has implemented the Job Loss Guarantee Program (JKP), which assists in the form of cash as well as access to job information and job training to workers affected by the termination of employment.

Thus, Ida continued, workers can benefit from two employment social security programs, namely the JHT and JKP Programs.

"There are already laid-off workers who claim and get cash from the JKP program", she said.

As information, the JHT program had become a polemic after the Minister of Manpower issued Minister of Manpower Regulation Number 2 of 2022. In this regulation, the time for disbursement of JHT has been determined.

Where in Article 3 of the Minister of Manpower Number 2 of 2022, JHT benefits can only be obtained by workers who become BPJS Kesehatan participants when they reach 56 years of age.

JHT benefits for Participants who reach the age of 56 years include workers who stop working either because they resign, get laid off, or leave Indonesia for good.

The disbursement is much different when compared to the old rules. The reason is, in the old regulation, Minister of Manpower Regulation 19 of 2015, the retirement age limit for workers who can disburse Old Age Security Benefits (JHT) is not regulated.
