Losing The Lawsuit Of Flood Victims In The Administrative Court, Anies Must Dredge Mampang River

JAKARTA - The Jakarta State Administrative Court (PTUN) has partially granted the claims of residents of the Mampang River flood victims. This is stated in the lawsuit with case number 205/G/TF/2021/PTUN.JKT.

This means that the Governor of DKI Jakarta, Anies Baswedan, as the defendant, was defeated in the lawsuit and is obliged to carry out the PTUN decision.

It was stated that the PTUN required Anies to carry out a total dredging of the Mampang River to the Pondok Jaya area, which has not yet been completed. In addition, Anies also had to build sheet piles on the river around Pela Mampang Village.

"Declaring that the defendant's actions are cancelled in the form of the dredging of the Mampang River which has not been completed to the Pondok Jaya area; and the construction of river sheet piles in the Pela Mampang village is not completed. Requires the Defendant to carry out the dredging of the Mampang River completely to the Pondok Jaya area. Processing the construction of river sheet piles in the village Pela Mampang," said the PTUN verdict quoted on Thursday, February 17.

In addition, the Administrative Court also sentenced Anies to pay court fees of Rp2,618,300.

There are some claims made by residents of flood victims around Mampang River which were not granted by the Jakarta Administrative Court. The lawsuit is to compensate residents for losses due to flooding of around Rp. 1 billion.

For information, this lawsuit was filed by seven residents since last August 2021. The residents included Tri Andarsanti Pursita, Jeanny Lamtiur Simanjuntak, Gunawan Wibisono, Yusnelly Suryadi D, Shanty Widhiyanti, Virza Syafaat Sasmitawidjaja, and Indra. They are residents of Jakarta who became victims of floods in early 2021.

The plaintiffs had previously sent an administrative objection letter on March 5, 2021 to the Governor of DKI Jakarta which the defendant responded to on May 5, 2021. However, Anies did not accommodate the request in the letter.

Furthermore, the plaintiffs have sent an administrative appeal letter on April 9, 2021 to the President of the Republic of Indonesia, in this case to the Minister of Home Affairs as the supervisor of the Governor of DKI Jakarta.

Then on June 10, 2021, the plaintiffs received a letter of response from the Secretariat General of the Ministry of Home Affairs which explained that what the plaintiffs had requested was being processed with the regional government and the relevant Ministries or Institutions.

The plaintiffs saw this answer as inappropriate and did not respond to their demands. Observing all of that, the lawsuit to the Administrative Court became the next step and finally the lawsuit was partially granted.
