Case Of Used Antigen Device At Kualanamu Airport, Ex Manager Of Kimia Farma Diagnostics Sentenced To 10 Years In Prison

MEDAN - The judges of the Lubuk Pakam District Court (PN) sentenced the former Business Manager of PT Kimia Farma Diagnostika (KFD) Medan-Aceh, Picandi Masco Jaya, to 10 years in prison.

The panel of judges stated that the defendant was found guilty of using the beka antigen test kit at Kualanamu Airport from December 2020 to April 2021.

In his decision, the judge declared Picandi guilty of violating Article 196 of the Republic of Indonesia Law Number 36 of 2009 concerning Health in conjunction with Article 55 paragraph (1) of the 2nd Criminal Code in conjunction with Article 65 paragraph (1) of the Criminal Code.

"The defendant Picandi Masco Jaya has been sentenced to 10 years in prison," said the panel of judges chaired by Rosihan Juhriah in the trial, Thursday, January 27.

In addition to criminal penalties, the panel of judges also imposed additional penalties in the form of a fine of IDR 1 billion.

"With the provisions, if the fine is not paid, it will be replaced with imprisonment for 1 year," said Rosihan.

The judge's decision was much lighter than the demands of the public prosecutor (JPU), namely 20 years in prison and a fine of IDR 5 billion, subsidiary of 6 months in prison. Regarding this decision, the prosecutor and the defendant expressed their thoughts.

In addition to Picandi, the Lubuk Pakam District Court also held a trial for 4 Picandi staff involved in this illegal practice. They are Sepipa Razi, Depi Jaya, Marzuki and Renaldio.

They are subject to the same article as Picandi. The defendants Sepipa Razi and Depi Jaya were sentenced to 2 years and 6 months in prison. They are also required to pay a fine of IDR 1 billion each with a subsidiary of 1 year in prison.

This verdict is lighter than the prosecutor's demands, namely 5 years in prison, a fine of Rp. 100 million and a subsidiary of 3 months in prison.

Furthermore, the defendants Marzuki and Renaldio were each sentenced to 5 years in prison. They are also required to pay a fine of IDR 1 billion with a subsidiary of 1 year in prison.

Similar to the other defendants, this verdict is lighter than the prosecutor's demands, namely 10 years in prison with a fine of Rp. 1 billion, subsidiary to 6 months in prison.

It is known that 5 employees of PT Kimia Farma Diagnostik were named suspects in the case of used antigens at Kualanamu Airport. The five perpetrators conspired to recycle used rapid test kits for personal gain.
