Governor's Decree Revision Of DKI UMP 5.1 Percent Issued, Entrepreneur Prepares Lawsuit For Anies

JAKARTA - Anies Baswedan has officially issued DKI Jakarta Governor's Decree Number 1517 of 2021 concerning the 2022 Provincial Minimum Wage. In this decree, Anies set the 2022 UMP in DKI at IDR 4,641,854, an increase of 5.1 percent.

This Gubernatorial Decree is a revision that revokes Gubernatorial Decree No. 1359 of 2021 concerning DKI UMP, which stipulates an increase of 0.85 percent.

Since the beginning, the news of the revision of the DKI 2022 UMP has been protested by the Indonesian Employers' Association (Apindo). In fact, Apindo is already preparing to sue Anies to the Jakarta State Administrative Court (PTUN).

However, at that time, Apindo was still waiting for a copy of the governor's decree that revised the UMP amount. Now, after the governorship decree was issued, Apindo immediately studied the legal aspects, before finally filing a lawsuit.

"Of course we will respond to the governor's regulation (kepgub). We will coordinate to take the next steps, including legal steps," said Deputy Chairperson of DKI Jakarta Apindo DPP, Nurjaman in a short message to VOI, Tuesday, December 28.

It is known, the Ministry of Manpower has determined the formula for increasing the UMP to local governments based on Government Regulation Number 36 of 2021. For Jakarta, the formula for increasing the UMP from PP 36/2021 is 0.85 percent.

However, in order to realize the UMP amount which is higher than that, Anies uses three other legal bases. First, Anies uses Law Number 29 of 2007 concerning the DKI Jakarta Government as the Capital City of the Republic of Indonesia. The second is Law Number 23 of 2014 concerning Regional Government which was amended several times in the Job Creation Act Number 11 of 2020.

The third is Law Number 30 of 2014 concerning Government Administration which was amended in the Job Creation Law Number 11 of 2020.

Nurjaman admitted that entrepreneurs still stick to the determination of the UMP increase which refers to PP 36/2021. He considered that Anies's revised UMP increase to 5.1 percent violated the rules.

"The Governor has clearly changed (the amount of the increase in the 2022 UMP) and is there a regulation? Can we violate the Gubernatorial Regulation? If the Governor violates the PP? We can also violate the Gubernatorial Regulation, please. Don't teach us to break the regulations," said Nurjaman.
