Defendant Of Child Murder In Kupang Demands Death Penalty

KUPANG - The Public Prosecutor of the Oelamasi District Attorney, Kupang Regency, East Nusa Tenggara demanded the death penalty for Yunus Tanaem, the defendant in the murder and rape case of a minor.

The Public Prosecutor's demands were read out in a trial chaired by the Chief Justice Fransiskus Xaverius Lae with member judges Afhan Rizal and Fridwan Fina which took place virtually, Monday, December 27.

In the prosecutor's statement which was read by Pathres M Mandala and Sherlter F Wirata and Vinsya Murtningsi, it was stated that the death penalty was carried out against the defendant Yunus Tanem because he was proven to have committed premeditated murder and sexual intercourse with a minor.

The Public Prosecutor stated that Yunus Tanaem was proven by a premeditated plan to kill other people and abuse of children resulting in the death of the child and by deceit and a series of lies to persuade the child to have intercourse with the defendant.

According to the Public Prosecutor, the defendant Yunus Tanaem's actions violated the First Primary Article 340 of the Criminal Code and the first Article 80 paragraph (3) of the Republic of Indonesia Law Number 17 of 2016 concerning the Stipulation of Government Regulation in Lieu of Law Number 1 of 2016 concerning the Second Amendment to the Law. - Law of the Republic of Indonesia Number 23 of 2002 concerning Child Protection and Article 81 paragraph (2) of Law of the Republic of Indonesia Number 17 of 2016 concerning Stipulation of Government Regulation in Lieu of Law Number 1 of 2016 concerning the Second Amendment to Law of the Republic of Indonesia Number 23 of 2002 concerning Child protection.

In his indictment, the Public Prosecutor demanded that the defendant Yunus Tanaem be sentenced to death because he had planned and killed the life of a child by trickery, which was a very heinous act of humanity.

During the trial the defendant Yunus Tanaem attended the trial virtually from the Class II A Detention Center Kupang.

Meanwhile, Head of the Legal Information and Public Relations Section of the NTT High Prosecutor's Office, Abdul Hakim, said that the demand for the death penalty against Yunus Tanaem was fully supported by the Head of the NTT High Prosecutor's Office, Yulianto.

"The demand for the death penalty is carried out as a deterrent effect so that there will be no more cases of murder and rape of children in areas in NTT. Moreover, the case carried out by the defendant was planned with a very heinous act," said Abdul Hakim, quoted by Antara.

According to Abdul Hakim, the demand for the death penalty against a defendant in a criminal case is the first time that the public prosecutor has made a request for the death penalty in NTT.
