KPK Investigation According To Law, South Jakarta District Court Rejects Lawsuit Of Inactive Kuansing Regent Andi Putra

JAKARTA - South Jakarta District Court (PN Jaksel) Judge Mardison rejected the lawsuit from the inactive Kuantan Singingi (Kuansing) Regent Andi Putra (AP) against the Corruption Eradication Commission (KPK) regarding the investigation into the alleged bribery case for extending the right to use oil palm concession (HGU).

"Because the defendant's determination of the suspect, confiscation and detention was in accordance with statutory regulations, the applicant's application was rejected in its entirety," Mardison said at the Kuansing Regent's Pretrial Decision Reading Session in Jakarta, Antara, Monday, December 27.

In legal considerations, Mardison stated that the respondent, namely the KPK, had proven that the investigative actions carried out by the KPK against the Kuansing Regent Andi Putra were in accordance with the KPK Law and the Criminal Procedure Code (KUHAP).

The evidence carried out by the KPK is through the inclusion of evidence in the form of an investigation warrant, a wiretapping order, and an investigation warrant stating the applicant is a suspect in a corruption crime, a warrant to conduct a search, and news of an extension of detention.

"The court is of the opinion that the respondent can prove that the determination of the suspect made by the respondent to the applicant is based on two or more valid pieces of evidence," said Mardison.

The KPK has named Andi Putra and General Manager PT Adimulia Agrolestari (AA) Sudarso (SDR) as suspects in the alleged bribery case related to the extension of the palm oil use rights (HGU) permit in Kuansing Regency, Riau, Tuesday, 19 October.

Andi Putra is alleged to have received Rp500 million from Sudarso in September 2021 and Rp200 million in October 2021. Thus, Andi Putra has received Rp700 million from the minimum amount of money that must be paid by Sudarso, which is Rp2 billion.
