Jokowi Sends Surpres, Sufmi Dasco Says DPR Will Discuss Revision Of ITE Law In Future Session

JAKARTYA - Deputy Speaker of the House of Representatives Sufmi Dasco Ahmad confirmed that a presidential letter (surpres) on the revision of the Information and Electronic Transactions (ITE) Law had been officially sent to the Indonesian House of Representatives.

The presidential decree regarding the revision of the ITE Law was received by the leadership at the closing of the second session of the DPR for the 2021-2022 session, last Thursday, December 16.

Therefore, Dasco said, the revision of the new ITE Law will be processed during the next trial or after the opening of the trial period next year.

"The presidential decree regarding the revision of the ITE Law came or arrived at the DPR on December 16 at the closing of the trial period. So that it will only be processed according to the applicable mechanism at the next trial," Dasco told reporters, Friday, December 24.

However, said Dasco, the discussion of the law will still be carried out according to the priority National Legislation Program that has been determined in the plenary meeting. So, according to Dasco, the process of completing the revision of the law will be adjusted to the matrix that has been prepared by the DPR.

"As we know that the priority National Legislation Program has priorities in accordance with the order, and of course we will immediately process it according to the existing order and will be completed according to the matrix that will be compiled by the DPR," said Dasco.

Previously, Coordinating Minister for Political, Legal and Security Affairs (Menko Polhukam) Mahfud MD said President Joko Widodo had sent a presidential letter related to the Second Amendment Bill to Law Number 11 of 2008 concerning Information and Electronic Transactions to the DPR.

"The letter has been signed by the President, and the Presidential Letter (Surpres) has been sent to the DPR RI on December 16, 2021," Mahfud said in a press release, in Jakarta, Friday.

The Presidential Letter dated December 16, 2021, Numbered R-58/Pres/12/202 with the subject of the Bill on the Second Amendment to Law No. 11/2008 concerning Information and Electronic Transactions (ITE) and attach a document of the draft bill.

In the contents of the letter, in addition to submitting the bill, he said, the bill was immediately discussed in the DPR RI session to get approval with top priority.

The President's letter, said Mahfud, stated that for the purposes of discussing the bill, the President assigned the Minister of Communication and Information as well as the Minister of Law and Human Rights to represent the government in discussing the bill.

The government will revise the ITE Law on a limited basis with regard to substance. There are four articles that will be revised, namely articles 27, 28, 29, and 36. In addition to the revision of the four articles, he said, there will be the addition of a new article in the revision of the ITE Law, namely Article 45C.
