Not Satisfied With Judge's Decision, KPK Files An Appeal In RJ Lino's Case

JAKARTA - The Corruption Eradication Commission (KPK) has filed an appeal against the decision handed down by the Jakarta Corruption Court against the former President Director of PT Pelabuhan Indonesia (Pelindo) II, Richard Joost (RJ) Lino. The appeal was filed on Monday, December 20.

Acting KPK Spokesperson for Enforcement, Ali Fikri, said the appeal was filed because there was no reimbursement for the Wuxi Hua Dong Heavy Machinery Science and Technology Group Co. company. Ltd (HDHM) in China.

"The KPK Prosecutor's Team has declared an appeal in the case of defendant RJ Lino through the clerk of the Corruption Court at the Central Jakarta District Court," Ali told reporters at the KPK Merah Putih building, Kuningan Persada, South Jakarta, Tuesday, December 21.

Ali said that the charge for the replacement money proposed by the KPK to the foreign company reached 1,997,740,23 US dollars or equivalent to Rp. 28 billion.

"A complete description of the reasons for the prosecutor's appeal will be contained in the memorandum of appeal which will soon be sent to the Jakarta High Court," he said.

Furthermore, the KPK hopes that the panel of judges will consider and impose additional penalties such as the demands of the KPK Public Prosecutor (JPU). The goal is that the deterrent effect can be felt by the perpetrators of corruption.

"Handling corruption as an extraordinary crime, of course, is not only a matter of law enforcement for the sake of justice, but how law enforcement is also able to provide a deterrent effect to prevent similar acts from happening again, including through fines, replacement money, and confiscation of assets resulting from criminal acts for cash income. country," said Ali.

As previously reported, RJ Lino was sentenced to 4 years in prison plus a fine of Rp. 500 million, subsidiary to 6 months in prison for being proven guilty of corruption in the procurement and maintenance of 3 QCC units in 2010 at Panjang Port (Lampung), Pontianak (West Kalimantan), and Palembang Port (South Sumatra). .

However, Rosmina as the chairman of the panel of judges submitted a dissenting opinion and stated that RJ Lino had no malicious intent so that he could not be sentenced.

Even so, he was still found guilty because two judges, namely the first member judge Teguh Santoso and the second member judge as ad hoc corruption judge Agus Salim. Both believe that RJ Lino committed corruption.
