JAKARTA - The discussion on the draft law on the Crime of Sexual Violence (RUU TPKS) is being continued in the DPR.

The head of the working committee (Panja), Willy Aditya, claimed that the TPKS Bill was different from the Regulation of the Minister of Education and Culture, Research Technology (Permendikbud) Number 30/2021 on the Prevention and Handling of Sexual Violence. Where in it include sexual consent.

"That's a misperception, friends will see later, we don't include sexual consent at all. This is different from the Permendikbud, so the public doesn't have to worry," said Willy at the DPR Building, Wednesday, November 17.

The Deputy Chairman of the Legislation Body (Baleg) of the DPR explained that this bill does not justify free sex as some parties have called it. In fact, he emphasized again, this bill does not include sexual consent or sexual consent in it.

"We drafted this bill with great care and socio-cultural basis. So the word sexual consent is not included in this bill," said Willy.

The TPKS Bill, Willy continued, aims to provide a legal umbrella for victims of sexual violence to get justice. Coupled with the points of prevention of sexual violence that are no less important. "So the perspective of the victim, legal umbrella, prevention, and action," he said.

Even so, Willy said, there are a number of debates that must be resolved in the further discussion of the Sexual Violence Bill in the Legislative Body (Baleg) of the Indonesian House of Representatives.

At least, he said, there were eight points that were debated in the discussion of the TPKS Bill. One of the debates is about the title. Namely, there were proposals from a number of members of the working committee who suggested that the word prevention be included in the title of the TPKS Bill. Then the arrangement for the prevention element, the Nasdem Party politician said, the Panja members wanted the prevention provisions to be the initial part of the TPKS Bill. Likewise, the issue of the mechanism for the trial of sexual violence is also a matter of debate. "Whether (the mechanism for the trial of sexual violence) is limited or closed," he said. Then, the use of the word rehabilitation for victims. At least there is a suggestion to use the word rehabilitation or recovery. Therefore, he hopes that the difference of opinion can be resolved in today's meeting. Thus, the draft of the TPKS Bill can be ratified immediately. "I as the Chair of the Panja hope that a decision will be taken as soon as possible," concluded Willy.
